GENERAL VOLUNTEER WAIVER

RECITALS

WHEREAS, Organization operates and supervises volunteer activities, programs and events and requires execution of releases and waivers to permit participation; and

WHEREAS, Volunteer desires to provide volunteer services for Organization in connection with to be held on at .

WHEREAS, the parties wish to set forth the terms under which Volunteer will participate and the extent of the release of liability and related commitments.

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:

1. DEFINITIONS

"Organization" means the named organization above and its officers, directors, employees, volunteers, agents, contractors, successors and assigns. "Volunteer" means the individual identified above and, where applicable, that individual's heirs, executors, administrators and legal representatives.

2. ASSUMPTION OF RISK

Volunteer acknowledges and understands that participation in volunteer activities may involve inherent risks, hazards and dangers, including but not limited to physical injury, illness, property damage, and exposure to communicable disease. Volunteer voluntarily assumes full responsibility for all such risks, whether known or unknown, foreseen or unforeseen, arising from or related to Volunteer’s participation.

3. WAIVER AND RELEASE OF LIABILITY

To the fullest extent permitted by law, Volunteer, on behalf of Volunteer and Volunteer’s heirs, personal representatives, successors and assigns, hereby releases, waives, discharges and covenants not to sue Organization and its affiliates, officers, directors, employees, agents, volunteers and representatives (collectively, "Released Parties") from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs and expenses (including attorneys' fees) arising out of or in any way connected with Volunteer’s participation in the volunteer activity, whether caused by the negligence of the Released Parties or otherwise.

4. INDEMNIFICATION

Volunteer shall defend, indemnify and hold harmless the Released Parties from and against any and all claims, demands, liabilities, losses or expenses, including reasonable attorneys’ fees, resulting from Volunteer’s negligent, reckless or intentional acts or omissions while participating in volunteer activities, including claims brought by third parties.

5. MEDICAL AUTHORIZATION

Volunteer authorizes Organization to obtain emergency medical treatment for Volunteer if, in the judgment of Organization or its representatives, such treatment is necessary. Volunteer agrees to be solely responsible for any costs associated with such medical care. Volunteer hereby releases and holds harmless the Released Parties from any claim arising out of such emergency medical treatment.

Volunteer grants Organization the irrevocable, perpetual, worldwide right to photograph, record, edit and use Volunteer’s image, likeness, voice and/or statements in any media for promotional, educational, and any other lawful purpose without further compensation. Volunteer waives any right to inspect or approve uses and releases Released Parties from any claims related to such use.

8. CONDUCT, COMPLIANCE AND SAFETY

Volunteer agrees to comply with all applicable laws, organizational policies, safety rules and the direction of Organization staff and supervisors. Volunteer shall perform duties in a safe and responsible manner and shall immediately report accidents, injuries, unsafe conditions or incidents to Organization personnel.

9. CONFIDENTIALITY

Volunteer agrees not to disclose confidential, proprietary or personal information obtained during the course of volunteering, except as required by law or with prior written authorization from Organization. Confidential information includes but is not limited to donor information, participant records, and non-public operational procedures.

10. INSURANCE

Volunteer acknowledges that Organization may not provide liability or medical insurance for Volunteers. Volunteer is solely responsible for obtaining any personal insurance coverage. Volunteer’s health insurance carrier and policy number (if any):

Any notice, demand or other communication required or permitted under this Agreement shall be in writing and delivered to the parties at the addresses set forth above or to such other address as either party may designate in writing.

12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state in which Organization maintains its principal place of business, without regard to conflict of laws principles.

13. ENTIRE AGREEMENT; SEVERABILITY

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations or agreements. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. AMENDMENT; WAIVER; COUNTERPARTS

Any amendment to this Agreement must be in writing and signed by both parties. Failure by either party to enforce any provision shall not constitute a waiver of that provision. This Agreement may be executed in counterparts, each of which shall be deemed an original but all of which together shall constitute one instrument.

Volunteer represents and warrants that Volunteer is physically and mentally capable of participating in the volunteer activities described, and that Volunteer is not under the influence of alcohol or any controlled substance while performing volunteer services.
