What a Gift Ban Agreement Is and When It Applies

A Gift Ban Agreement is a written contract that prohibits the receipt or solicitation of gifts, favors, or other items of value between specified parties for a defined period. It is commonly used by public entities, employers, grantmakers, and nonprofit organizations to manage conflicts of interest and maintain compliance with ethics rules. The agreement defines prohibited items, reporting obligations, exceptions, effective dates, and remedies for breaches. Proper execution, retention, and distribution ensure the document serves as enforceable evidence of the parties' obligations and the organization's compliance program.

Why organizations use a Gift Ban Agreement

Gift Ban Agreements reduce conflicts of interest, protect organizational integrity, and document expectations for staff, contractors, and officials. They create a clear standard for what constitutes a prohibited gift and streamline enforcement and disclosure procedures under ethics rules.

Why organizations use a Gift Ban Agreement

Who commonly completes a Gift Ban Agreement

Organizations use gift bans in contexts that require objective oversight and documented avoidance of undue influence.

  • Public officials and agency staff: employees subject to state or local ethics codes and disclosure rules.
  • Contractors and vendors: third parties whose proximity to procurement creates risk of undue influence.
  • Grant recipients and board members: individuals who must avoid perceived or actual conflicts of interest.

Tailor the agreement to the role, risk level, and applicable ethics or contract rules for the party signing it.
