SELLER warrants that the above-described pet is a purebred registerable with the and that registration papers have have not been provided to the BUYER as of the date of purchase, in addition to a true and verifiable copy of pedigree. 2. SELLER warrants that the above-described domestic pet is in good health at the time BUYER assumes ownership and for a period of hours subsequent to transfer of ownership. Animals are guaranteed against any congenital or hereditary defects. SELLER recommends that BUYER agrees to have said animal examined by a licensed veterinarian within hours of transfer of ownership. This guarantee of health shall extend for hours from the time of shipping/delivery of the pet to BUYER. BUYER or veterinarian must report to SELLER any medical problems within the period of guarantee. If animal is deemed by a veterinarian to be in “unsound health” then BUYER may request a refund or replacement for another animal of equal value. “Unsound health” shall be defined as any condition that is “life threatening” or “incurable”. SELLER reserves the right to offer monetary compensation in lieu of a replacement anim al but is in no way obligated to do so. SELLER is not responsible for defects or imperfections not evident at the time of sale that do not constitute “unsound health”. Failure to report any defects or medical problems within this time frame shall void this warranty. BUYER agrees upon notice of defect or medical problems that the animal purchased shall be returned to SELLER. The animal shall not be sold, leased, or given to any pet shop, individual, or research establishment. BUYER agrees that he/she is not acting as an agent in the purchase of this animal and at no time shall the animal be sold, given, or donated to any person without SELLER’S prior knowledge and consent. In the event of the BUYER being unable to maintain the animal, the Breeder shall be informed and shall reserve the right to repossess the animal at any age. There shall be no refunds of shipping and/or delivery charges or of any charges associated with such in the event that BUYER returns animal to SELLER. If SELLER agrees to exchange animal for an animal of comparable quality, BUYER agrees that they may have to wait up to one year to obtain a replacement. 3. BUYER warrants that the animal will be kept in appropriate conditions for its hea lth and welfare and shall not be neglected in any manner. BUYER further understands that if there is a failure to uphold any part of this contract, or if the pet is neglected, maltreated, or is failing to receive adequate medical care, BUYER shall surrender the animal to SELLER unconditionally and without financial re stitution or compensation. 4. If delivery is requested by the BUYER, it shall be by airfreight, C.O.D. to an agreed upon location. BUYER shall be responsible for all costs including insurance and cost of freight charges during shipm ent. 2 Copyright 2004 USLegalforms.com BUYER shall reimburse SELLER for any costs incurred by SELLER in preparation for shipment and delivery of the animal. If delivered, the animal will come with a Veterinaria n’s health certificate for the purpose of shipping. A record of vaccinations and dewormings will also accompany the animal. 5. The animal is not guaranteed against accidental death or injury, including acci dents occurring during or after shipping and delivery. 6. The animal is not guaranteed against any adverse reactions from environmental change s occurring as a result of entering a new living arrangement upon purchase by the BUYER. 7. This contract contains the entire agreement between the parties and no state ments, promises or inducements made by either party that is not contained in this written agreeme nt shall be valid or binding. This contract shall not be altered except upon mutual agreement and endorsements of both BUYER and SELLER. 8. It is the purpose of this contract in part to advance, advocate, and perpetuate the sa fety and welfare of this animal(s) and to protect the interests of both the BUYER and SELLER. A breach by any party to this contract shall act as a release to the other from performing any of the obligations as otherwise agreed.
