Guaranty Terms and Acknowledgments

By signing this Guarantor Lease Application, Guarantor unconditionally and irrevocably guarantees to Lessor the full and punctual payment of all rent and other sums due under the Lease and the full and punctual performance of all other obligations of Tenant under the Lease (the "Guaranty"). This Guaranty is an absolute, continuing, primary and unconditional guaranty of payment and not merely of collection.

Guarantor waives presentment, demand for payment, notice of nonpayment, protest, notice of protest and all notices of any kind, and all defenses arising by reason of any disability or other defense of Tenant. Guarantor agrees that Lessor may, without notice or consent of Guarantor, extend or modify the Lease or enter into other agreements with Tenant or Guarantor, and such action shall not relieve Guarantor of liability hereunder.

Upon Tenant's default, Guarantor shall pay all sums due within ten (10) days after written demand. Guarantor will also reimburse Lessor for all costs and expenses, including reasonable attorneys' fees, incurred in enforcing this Guaranty.

This Guaranty shall continue in full force and effect until all obligations under the Lease are fully performed and shall bind Guarantor's successors and permitted assigns. This Guaranty is governed by the laws of the state in which the Property is located.

Authorization and Consent

Guarantor authorizes Lessor and its agents to obtain consumer credit reports, criminal background reports, eviction history, employment verification and other tenant-screening information for the purpose of evaluating this application. Guarantor further authorizes the release of such information to Lessor upon request.
