GUEST CONFIRMATION AGREEMENT

This Guest Confirmation Agreement (the Agreement) is entered into between Guest Name: and Host Name: on Effective Date: . The parties agree as follows.

RECITALS

WHEREAS, Host operates the premises or provides the accommodation described herein and has represented availability for the dates specified below; and

WHEREAS, Guest has requested reservation of the accommodation and agreed to the terms and payment obligations set forth in this Agreement; and

WHEREAS, the parties wish to confirm the reservation, payment terms, cancellation rights, and other obligations relating to the Guest's stay.

NOW THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

2. PAYMENT TERMS

Guest shall pay the Deposit as stated above to secure the reservation. The balance is due in full at Host's check-in or at the time specified in the reservation confirmation. 3. CANCELLATION AND MODIFICATION

Guest may cancel or modify the reservation subject to the following schedule: cancellations made more than 14 days prior to Arrival Date are eligible for a full refund of the Deposit less any non-refundable fees; cancellations made between 7 and 14 days prior to Arrival Date are subject to forfeiture of 50% of the Deposit; cancellations made within 7 days prior to Arrival Date will forfeit the entire Deposit. Host may, in its sole discretion, waive or reduce cancellation charges in extraordinary circumstances.

4. GUEST RESPONSIBILITIES

Guest shall comply with all applicable laws, rules, and Host policies while on the premises. Guest is responsible for the conduct of all accompanying persons and agrees to pay for any damage, excessive cleaning, or loss caused by Guest or accompanying persons. Occupancy limits must not be exceeded.

5. HOST OBLIGATIONS

Host shall make the accommodation available to Guest as described and shall provide usual utilities and services. Host will use commercially reasonable efforts to remedy any confirmed deficiencies promptly upon notice from Guest.

6. LIMITATION OF LIABILITY AND INDEMNIFICATION

EXCEPT FOR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF THIS AGREEMENT. GUEST AGREES TO INDEMNIFY, DEFEND, AND HOLD HARMLESS HOST FROM CLAIMS ARISING FROM GUEST'S USE OF THE ACCOMMODATION, INCLUDING PERSONAL INJURY, DAMAGE TO PROPERTY, OR NON-COMPLIANCE WITH LAWS.

7. PRIVACY AND PERSONAL DATA

Host may collect and process Guest personal data necessary to perform the reservation and comply with legal obligations. Guest consents to such collection and processing. Host will store personal data in accordance with reasonable confidentiality practices.

8. FORCE MAJEURE

Neither party shall be liable for delay or failure to perform its obligations hereunder to the extent such delay or failure is caused by events beyond its reasonable control, including but not limited to acts of God, government action, pandemic, fire, flood, strikes, or utility failures. The affected party must give prompt written notice to the other and use reasonable efforts to resume performance.

9. NOTICES

All notices required or permitted under this Agreement must be in writing and delivered to the addresses provided below in person, by certified mail, or by nationally recognized courier service.

10. GOVERNING LAW; ENTIRE AGREEMENT; SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the state or jurisdiction in which the Host's property is located, without regard to its conflict of law rules. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations and understandings. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.

11. AMENDMENTS; WAIVER; COUNTERPARTS

Any amendment to this Agreement must be in writing and signed by both parties. No waiver shall be effective unless in writing and signed by the waiving party. This Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one instrument.
