What a Guest House Rental Agreement Covers

A Guest House Rental Agreement is a written contract that sets the terms under which a property owner or manager rents a secondary dwelling (guest house, cottage, or accessory unit) to a tenant. It defines the parties, address, rental term, rent amount and payment schedule, security deposit, permitted use, maintenance obligations, utilities, access and key rules, insurance responsibilities, and procedures for early termination and holding over. A clear agreement reduces ambiguity about possession, repairs, and liability and provides the basis for remedies if either party breaches the contract.

Why a Clear Guest House Agreement Matters

A written agreement creates enforceable expectations for rent, maintenance, and liability, reduces disputes, and documents consent for shorter or accessory-unit tenancies; it also supports compliance with state landlord-tenant laws and tax reporting requirements.

Why a Clear Guest House Agreement Matters

Who Typically Prepares and Signs This Agreement

Owners, property managers, and tenants use this agreement to document short- or long-term occupancy of a guest house or accessory dwelling.

  • Owner or Landlord: Individual or entity that owns the guest house and sets rental terms.
  • Property Manager: A delegated agent who administers rent, repairs, and notices under a management agreement.
  • Tenant or Guest: The individual or household granted possession and responsible for rent and compliance.

Parties should confirm signatory authority and local legal requirements before signing to avoid enforcement issues.

Who Can Sign on Behalf of Parties

Owner — Individual/Officer

If an individual owns the property they sign personally. For corporate or LLC owners, an authorized officer or manager must sign and include their title; attach a resolution or power of attorney if authority is delegated.

Tenant — Authorized Signer

All adult tenants intended to be bound should sign. If signing for another (guardian, corporate tenant), include documentary authority such as a power of attorney or corporate authorization.

Core Elements to Include in a Professional Guest House Rental Agreement

A complete agreement reduces interpretation risk. Include essential clauses, clear schedules, and contact information so both parties understand obligations and remedies.

Identification

Full legal names of owner and tenant, and the guest house street address, unit identifier, and mailing address if different.

Term & Renewal

Explicit start and end dates, rent due date, renewal options, and holdover terms for stays beyond the agreed term.

Rent & Payments

Monthly rent amount, acceptable payment methods, late fees or grace period, returned-check fees, and where to deliver payment.

Security Deposit

Deposit amount, permitted deductions, interest and escrow rules where required by state law, and timeline for return after move-out.

Use & Occupancy

Permitted occupants, guest limits, short-term subleasing or short-term rental restrictions, and noise or nuisance rules.

Repairs & Maintenance

Who handles routine maintenance, emergency repairs, utilities allocation, and procedures for requesting service or reporting damage.
