ASSUMPTION OF RISK

The Guest understands and expressly acknowledges that participation in the activities described in Scope of Activities involves risks and dangers, including but not limited to bodily injury, permanent disability, death, property damage, which may arise from the Guest's own actions or inactions, the actions or inactions of others, or the condition of the premises. Guest Name: knowingly and voluntarily assumes all such risks.

RELEASE, WAIVER AND COVENANT NOT TO SUE

In consideration of being permitted to enter the premises and/or participate in the activities, the Guest, on behalf of himself or herself and the Guest's heirs, assigns, personal representatives and next of kin, hereby fully and forever releases, waives, discharges and covenants not to sue the Host, its officers, directors, employees, agents and volunteers (collectively "Released Parties") from any and all liabilities, claims, causes of action, demands or suits, whether known or unknown, arising out of or in any way connected with the Guest's presence or participation, including claims arising from the negligence of the Released Parties.

INDEMNIFICATION

The Guest agrees to indemnify, defend and hold harmless the Released Parties from and against any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) resulting from any claim, demand or action arising out of or related to the Guest's acts or omissions while on the Host's premises or participating in the activities.

MEDICAL AUTHORIZATION

In the event of injury or illness, the Guest authorizes the Host to obtain emergency medical care and transport as reasonably necessary. The Guest understands that the Guest is financially responsible for any such medical treatment. Known allergies/medical conditions:

Where applicable, Guest agrees to pay fees and charges required by the Host as consideration for access or services described in the Scope of Activities.

TERM AND TERMINATION

This Release is effective for the period commencing on Start Date: and ending on End Date: unless earlier terminated in writing. Either party may terminate participation by providing Notice Period (days): days' prior written notice.

CONFIDENTIALITY

The Guest shall not disclose confidential or proprietary information of the Host obtained during the visit, except as required by law. Confidential information includes non-public business practices, safety procedures, technical data, and other materials identified in writing as confidential.

GOVERNING LAW; ENTIRE AGREEMENT; SEVERABILITY

This Release shall be governed by and construed in accordance with the laws of the jurisdiction in which the Host's premises are located. This Release constitutes the entire agreement between the parties regarding the subject matter herein and supersedes all prior discussions and agreements. If any provision of this Release is held invalid or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT AND CERTIFICATION

By signing below, the Guest certifies that the Guest has read this Release carefully, understands its terms, acknowledges that the Guest is giving up substantial legal rights by signing, and signs it voluntarily.
