What the Hazardous Material Disclosure Form Is

A Hazardous Material Disclosure Form is a written record that identifies hazardous substances present in property, shipments, equipment, or premises and summarizes their classification, quantity, and handling requirements. In the United States it documents hazards for buyers, tenants, carriers, and emergency responders, and often references safety data sheets (SDS). The form supports regulatory compliance, emergency planning, and informed decision-making by providing contact details, storage locations, and any applicable transport or disposal codes.

Why accurate disclosure matters

Completing a Hazardous Material Disclosure Form reduces safety risks, supports regulatory compliance, and creates a clear record for liability management. Accurate disclosure helps emergency responders, protects workers and the public, and can reduce insurance disputes or enforcement actions.

Why accurate disclosure matters

Who typically completes and relies on this form

Parties involved include those that create, transfer, store, or manage hazardous materials; responsibilities vary by role and industry.

  • Property sellers and landlords who must inform buyers or tenants about on-site hazardous substances.
  • Shippers and carriers handling regulated materials under DOT rules and manifesting hazardous cargo.
  • Facility managers, environmental health and safety staff, and contractors overseeing storage or remediation activities.

Accurate assignment of responsibility and record custody ensures the disclosure serves its safety and legal functions.
