HEALTHCARE BILLING AGREEMENT

If payment is not received within 30 days of the statement date, account may be subject to collection procedures, interest not to exceed 1.5% per month, and reasonable costs of collection including attorneys’ fees and court costs.


5. Assignment of Benefits and Authorizations

By checking the box below, patient assigns to Provider all rights to insurance benefits and directs payment of insurance benefits for services rendered to Provider when allowed by law. Patient further authorizes Provider to submit claims and to release medical and billing information to insurers, third-party administrators, and their agents as necessary to secure payment.

This authorization is limited to entities involved in payment or utilization review and will be treated consistent with applicable privacy laws.

If insurance pays Provider directly for services for which patient has paid Provider, Provider will issue a refund or credit to patient within a reasonable period after receipt of payment. Patient is responsible for timely submission of information required by the insurer. Patient remains responsible for balances resulting from insurer denials when such denials result from non-coverage, lack of medical necessity, coordination of benefits exclusions, or patient failure to provide accurate insurance information.

7. HIPAA Acknowledgment and Privacy

Patient acknowledges receipt of Provider’s Notice of Privacy Practices and understands that protected health information may be used and disclosed for treatment, payment and health care operations, including billing and collection. Patient may request restrictions on certain uses and disclosures; however, Provider is not required to agree to requested restrictions.

8. Duration, Revocation and Governing Law

This authorization and assignment remain in effect until the earlier of: (a) payment in full of all amounts due; (b) explicit revocation in writing signed by patient and delivered to Provider; or (c) the Authorization Expiration Date below. Revocation will not affect disclosures or actions taken in reliance upon this Agreement prior to revocation. This Agreement shall be governed by the laws of the state in which Provider maintains its principal place of business.

9. Dispute Resolution

Any dispute arising from billing, payment, or this Agreement shall first be submitted to good faith informal negotiations. If not resolved, disputes may be subject to mediation or arbitration if mutually agreed. Nothing in this Agreement prevents Provider from pursuing collection actions for unpaid balances where permitted by law.
