Risks, Benefits, and Consent

The Patient acknowledges receipt of a clear description of the services and that benefits expected include improved health, functional assistance, and/or symptom management. The Patient understands that, as with any care, there exist risks including but not limited to allergic reaction to medications, adverse events, and possible lack of improvement. The Patient has had the opportunity to ask questions and all questions have been answered to the Patient's satisfaction.

The Patient consents to receive the care services described in this Agreement and authorizes Provider to deliver those services in accordance with accepted clinical practice. The Patient retains the right to withdraw consent at any time by providing written notice as described below.

HIPAA and Privacy Authorization

The Patient acknowledges receipt of Provider's Notice of Privacy Practices and authorizes Provider to use and disclose the Patient's protected health information as necessary for treatment, payment, and healthcare operations in accordance with applicable privacy laws. Patient authorizes Provider to communicate information to the emergency contact named above when necessary for health and safety.

Cancellation and Termination

Liability, Indemnification, and Dispute Resolution

Provider will exercise reasonable care in delivering services. To the fullest extent permitted by law, Provider's liability for claims arising under this Agreement is limited to direct damages not to exceed the total fees paid by the Patient for the care package. Provider is not liable for indirect, special, or consequential damages.

The Patient agrees to indemnify and hold Provider harmless from claims arising from the Patient's failure to provide accurate medical information or to follow care instructions. Any dispute arising under this Agreement shall be resolved by binding arbitration in accordance with rules agreed by the parties, except where prohibited by law.

Emergency Care

In an emergency, Provider is authorized to arrange for emergency medical treatment when necessary for the Patient's health and safety. The Patient authorizes Provider to transfer to the nearest appropriate facility if immediate care is required and to disclose medical information necessary to obtain emergency treatment.
