Caregiver shall perform duties in a professional manner consistent with the standards of care applicable to home health and personal care providers. Caregiver shall not perform tasks that are beyond the scope of training or that require licensed medical personnel unless expressly authorized in writing and under supervision.

Medication Administration & Emergency Procedures

Unless specifically authorized in writing, Caregiver may only assist with self-administration of medications (e.g., reminding, opening containers). Administration of injections or other invasive procedures requires a licensed clinician. In the event of an emergency, Caregiver will take actions necessary to preserve life and contact emergency services and the Client's emergency contacts.

Confidentiality & HIPAA Authorization

Caregiver acknowledges that Client health information is confidential. Caregiver shall comply with applicable privacy and security requirements and shall use and disclose Protected Health Information only as necessary to perform duties. Client authorizes disclosure of necessary health information to the Caregiver and to other individuals or providers as specified:

Insurance, Liability, and Indemnification

The parties agree that Caregiver shall maintain appropriate liability insurance while providing services. Client understands that Caregiver is not a medical professional unless separately contracted. Each party shall indemnify and hold harmless the other from claims arising from the indemnifying party's negligence or willful misconduct.

Termination

Either party may terminate this Agreement with written notice. Notice periods, if any, should be agreed to by the parties below. Immediate termination is permitted for breach of material obligations or conduct that endangers the Client.

Recordkeeping, Access, and Audits

Caregiver will maintain written records of services provided, incidents, and changes in condition. Client or authorized representative may request access to these records in accordance with applicable privacy requirements.

Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the state agreed by the parties. The parties agree to attempt informal resolution of disputes prior to initiating litigation. Venue for any legal action shall be as specified by mutual agreement.
