HEALTHCARE CAREGIVER MASTER AGREEMENT

This Caregiver Master Agreement (the Agreement) is entered into on between Agency Name: (referred to as "Agency") and Caregiver Name: .

RECITALS

Agency provides non-medical and/or personal care services to clients in their place of residence. Caregiver is engaged to perform assigned caregiving services for Agency clients in accordance with the terms of this Agreement.

TERMS AND SCOPE OF SERVICES

1.1 Services: Caregiver shall perform tasks assigned by Agency, which may include personal care, activities of daily living, companionship, light housekeeping, medication reminders, and other non-invasive tasks as specified in individual client assignments. Caregiver will not perform skilled nursing, diagnosis, or any invasive medical procedure unless separately licensed and authorized in writing.

CAREGIVER INFORMATION & ONBOARDING

LICENSES, CERTIFICATIONS & BACKGROUND

Caregiver represents and warrants that all professional licenses, certifications, and training required by law and by Agency policy to perform assigned services are current, valid, and will be maintained. Caregiver authorizes Agency to conduct background checks and drug screening as a condition of assignment. Consent to background check: Yes Drug test consent

CONFIDENTIALITY AND HIPAA

Caregiver acknowledges that during the performance of services they will receive, create, or access individually identifiable health information. Caregiver shall comply with all applicable privacy and security requirements and Agency policies, including the nondisclosure of client protected health information except as permitted by law and Agency authorization. Caregiver shall execute any additional HIPAA authorizations and training required by Agency.

COMPENSATION, TIMEKEEPING & EXPENSES

Caregiver compensation, pay rate, and pay period shall be set by Agency in writing. Caregiver must record hours through Agency timekeeping procedures. Agency will reimburse pre-approved business expenses incurred in performance of duties upon submission of itemized receipts. Caregiver is responsible for accurate time reporting and may be subject to disciplinary action for falsification.

INSURANCE, LIABILITY & INDEMNIFICATION

Agency maintains liability insurance as required by law. Caregiver shall promptly notify Agency of any incident, injury, or claim arising out of the performance of duties. Caregiver agrees to indemnify and hold harmless Agency from claims resulting from Caregiver's intentional misconduct, gross negligence, or breach of law.

PATIENT / CLIENT MEDICAL AND INSURANCE INFORMATION

MEDICAL HISTORY (AS KNOWN)

TERMINATION & AMENDMENT

Either party may terminate this Agreement for any reason upon written notice to the other party as prescribed by Agency policy. Agency may suspend or remove Caregiver from assignments immediately for cause, including but not limited to client harm, gross negligence, falsification of time records, or violation of law.

DISPUTE RESOLUTION

The parties shall attempt to resolve disputes through good-faith negotiation. Any unresolved dispute may be submitted to binding arbitration under the rules selected by Agency, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction.

REPRESENTATIONS & WARRANTIES

Caregiver represents and warrants that they are authorized to work in the jurisdiction of assignment, are not subject to any limitation that would prevent performance of duties, and will comply with all applicable laws, regulations, and Agency policies.

RECORDS, AUDIT & TRAINING

Caregiver shall maintain required training records and documentation of services as required by Agency and permit audits. Caregiver agrees to attend mandatory training and comply with supervision directives.

AUTHORIZATION & TERM

This Agreement shall remain in effect until terminated in accordance with its terms. Caregiver authorizes Agency to share assignment-specific client information as necessary to provide care. Authorization expiration date:
