Waiver, Release and Indemnification

I, the undersigned guest, acknowledge that I am voluntarily entering the healthcare facility and that there are inherent risks of exposure to communicable illnesses during visits. I expressly assume those risks on my own behalf. In consideration of being permitted to enter and visit the patient identified above, I hereby release, waive and discharge the facility, its governing body, officers, employees, agents and volunteers (collectively the Facility Parties) from any and all claims, demands, causes of action, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of or related to any illness or injury that I may suffer as a result of my presence on facility premises, except where such harm is caused by the gross negligence or willful misconduct of a Facility Party.

I further agree to indemnify and hold harmless the Facility Parties from and against any claim, demand or cause of action, including costs of defense and attorneys' fees, arising out of or related to my failure to comply with facility policies and infection control directives, including but not limited to masking, screening and hand hygiene requirements.
