Procedure Description and Consent for iTero Digital Scanning

The provider will perform a non-invasive intraoral digital scan using an iTero digital scanning system. The scan captures digital images and three-dimensional digital models of the dentition and surrounding oral tissues for diagnosis, treatment planning, fabrication of appliances, and clinical recordkeeping. The scan does not involve ionizing radiation.

I understand the purpose of the scan, the nature of the procedure, and the expected benefits, including improved diagnostic accuracy and digital workflow for appliance fabrication. Reasonable alternatives to digital scanning, when applicable, include traditional physical impressions or foregoing imaging.

I acknowledge the following material risks and limitations: transient gagging or discomfort, limitations of digital capture leading to repeat scans if necessary, potential for data transmission errors, and the possibility that scanned data may not reproduce soft tissue details required for some appliances. No guarantee has been made regarding the outcome of any treatment based upon scanned data.

Data Use, Storage, and Disclosure

By signing this Agreement I authorize the collection, creation, storage, and use of digital scans and associated health information for my care. The provider may store scanned data on secure local systems and on secure cloud services operated by approved vendors for the purposes set forth in this Agreement.

I authorize disclosure of scanned data to dental laboratories, treatment planning services, referral providers, and insurance payors as necessary for appliance fabrication, treatment coordination, or claims processing. I understand that disclosures to third-party vendors are made under business associate agreements or similar contractual protections where applicable.

I understand that my identifiable health information will not be used for research, education, or marketing without separate written authorization, except that de-identified or aggregated data may be used for legitimate clinical, educational, or quality improvement purposes.

Authorizations and Acknowledgements

Please indicate your choices below by checking each box to provide specific consent where required:

Privacy Notice Acknowledgment

I acknowledge that I have been offered or provided with a copy of the provider's Notice of Privacy Practices describing how my protected health information may be used and disclosed and my rights with respect to that information.

Retention, Revocation, and Liability

Scanned data will be retained in accordance with the provider's record retention policy and applicable law. I understand that I may revoke this authorization at any time by delivering written notice to the provider, except to the extent that the provider has already acted in reliance on the authorization. Revocation will not affect disclosures made prior to receipt of revocation.

The provider and associated vendors will take reasonable steps to protect the confidentiality and security of my scanned data. To the extent permitted by law, I release the provider from liability for inadvertent disclosures that may occur despite reasonable safeguards.

Fees and Financial Responsibility

There is no additional fee for performing an iTero digital scan when provided as part of standard clinical services unless otherwise disclosed. I understand I remain responsible for any fees associated with appliances, laboratory services, or treatments created from scanned data that are not covered by my insurer.

Authorization Period

This authorization is effective on the date signed below and will remain in effect until: unless earlier revoked in writing.

Certification

I certify that I have read and fully understand this Healthcare iTero Agreement. I have had the opportunity to ask questions and have received satisfactory answers. My signature below indicates that I give informed consent for the digital scanning procedure and for the uses and disclosures of my scanned data as described above.

What the Healthcare Itero Agreement Covers

The Healthcare Itero Agreement is a standardized contractual template used to document terms between healthcare organizations and service providers for iterative clinical, technical, or administrative services. It typically defines scope of services, data handling and privacy obligations, responsibilities for protected health information (PHI), timelines, payment terms, and termination rights. The form is intended to be adaptable for use with patient-facing consent, vendor engagements, clinical pilots, or ongoing support arrangements while remaining compatible with electronic execution and audit-trail requirements under U.S. law.

Why using a clear Healthcare Itero Agreement matters

A clear agreement sets expectations for data sharing, PHI protection, service levels, and compliance obligations (including HIPAA). It reduces ambiguity, supports audits, and creates an auditable record suitable for electronic signing under U.S. e-signature law.

Why using a clear Healthcare Itero Agreement matters

Who typically completes the Healthcare Itero Agreement

Organizations and individuals who manage clinical services, vendor relationships, or patient data workflows commonly complete this agreement.

  • Healthcare providers and clinics — contracting with vendors for iterative clinical or technical services, ensuring PHI protections and operational controls.
  • Vendor and technology providers — documenting deliverables, data access limits, and support obligations when interacting with clinical systems.
  • Legal, compliance, and procurement teams — reviewing indemnities, liability limits, and ensuring required business associate agreements (BAAs) are attached.

Final review usually involves legal and compliance stakeholders to confirm HIPAA, contract, and organizational policy alignment.

Authorized signers and their roles

Medical Director

The Medical Director often signs for clinical acceptances and confirms that clinical workflows and data uses meet internal standards and regulatory obligations; signature binds the provider organization.

Vendor CEO

An authorized executive or delegated signatory for the vendor accepts commercial and liability terms, confirms operational capabilities, and consents to data handling provisions on behalf of the vendor.

Core components to include in a professional Healthcare Itero Agreement

A complete agreement balances operational detail with legal protections: scope, data handling, security, compliance, payment, and termination provisions form the backbone of a usable healthcare contract.

Scope of Work

Describe services, deliverables, performance measures, and acceptance criteria so both parties understand iterative milestones and expected outcomes during the engagement.

PHI and Data Handling

Define what PHI is accessed, permitted uses, data minimization, retention, and responsibilities to maintain confidentiality and integrity of records.

Security Controls

Specify required technical and organizational controls including encryption, access controls, logging, and incident response to align with HIPAA and organizational policy.

Business Associate Agreement

Attach or incorporate a BAA when the vendor handles PHI, detailing permitted uses, breach notification timelines, and subcontractor obligations.

Billing and Payment

State fees, invoicing cadence, dispute processes, and any milestone payments or credits tied to iterative deliverables.

Termination & Liability

Include termination rights, data return or destruction procedures, indemnification, and liability caps appropriate for the healthcare risk profile.

Step-by-step: complete and execute the Healthcare Itero Agreement

Follow these sequential steps to prepare, review, and execute the agreement with an auditable electronic signature process.

  • 01
Prepare draft: Populate scope, PHI categories, and deadlines.
  • 02
Attach BAA: Include a signed Business Associate Agreement if PHI will be handled.
  • 03
Internal review: Send to legal and compliance for approvals and redlines.
  • 04
Execute: Use an ESIGN/UETA-compliant eSignature with audit trail.

Configure the online workflow before sending

Standardize authentication, routing, and field behaviors to reduce signer friction and preserve evidentiary records.

Field Configuration
Authentication Method Email link or SMS code, stronger MFA for PHI access
Signing Order Specify sequential or parallel signer flow
Required Fields Mark names, dates, and initials as required
Audit Trail Enable IP, timestamp, and action logging

Digital signing and file-format considerations

Choose a signing platform that supports secure PDF/Word uploads, audit trails, and required compliance features for healthcare agreements.

  • File Types: PDF, DOCX supported
  • Integrations: Connectors for EHRs and cloud storage
  • Security: TLS and AES-256 encryption

Confirm that the selected platform can provide retention exports, evidence of consent, and (if needed) a signed BAA or equivalent contractual addendum.

Where to send and how execution flows

Routing the agreement clearly minimizes delays: identify recipient roles, set signer order, and provide instructions for acceptance and document return.

  • Upload Document: Upload final PDF or DOCX to the signing platform.
  • Place Fields: Add signature, date, and initial fields for each signer.
  • Set Authentication: Choose email, SMS, or knowledge-based authentication.
  • Deliver & Archive: Send signing links and store completed files with audit trail.

Typical timelines and processing expectations

Estimate times for each stage so stakeholders can plan onboarding and data-handling activities.

Draft Preparation Time:

1–5 business days depending on complexity

Internal Legal Review:

3–10 business days typical

Signer Response Window:

24–72 hours is common for electronic requests

BAA Execution:

Concurrent with agreement; allow 3–7 days

Archival:

Completed agreement exported and stored immediately

Penalties and risks from incorrect or incomplete agreements

HIPAA Violations: Civil and criminal liability
Breach Notification: Regulatory reporting obligations
Contract Disputes: Delayed payments or service interruptions
Data Misuse: Loss of patient trust
Invalid Execution: Re-execution costs and delays
Regulatory Fines: State or federal penalties

Common errors to avoid when preparing the agreement

  • Failing to attach or sign a Business Associate Agreement when the vendor will handle PHI, which creates compliance gaps and potential enforcement exposure.
  • Leaving scope language ambiguous, which leads to scope creep, disputes over deliverables, and invoicing disagreements during iterative work.
  • Using incorrect legal entity names or signer titles, causing authority questions and requiring re-execution for enforceability.
  • Not configuring authentication or audit logs for electronic signatures, reducing evidentiary value during audits or litigation.
