Risks, Limitations, and Disclaimer

Client acknowledges that nutrition counseling is advisory and not a substitute for medical care. Provider will not alter prescription medications without authorization from the client’s treating prescriber. Client understands risks associated with dietary changes, and agrees to notify Provider immediately of adverse reactions.

The Provider does not guarantee specific results. Liability for any claims arising from services performed is limited to direct damages not to exceed total fees paid to Provider for the prior six months. Provider is not liable for indirect, consequential, or punitive damages.

Confidentiality, Authorization, and Privacy

Provider shall maintain confidential health information in accordance with applicable privacy and health information laws. By signing, Client authorizes Provider to access and use health information necessary to provide nutrition services and to communicate with other health care practitioners as needed for coordination of care.

Termination and Governing Law

Either party may terminate this Agreement with written notice. Upon termination Client is responsible for fees for services rendered through the date of termination. This Agreement shall be governed by the laws of the state in which Provider principally practices. If any provision is held invalid, remaining provisions remain effective.

Dispute Resolution

Parties agree to attempt resolution of disputes through good faith negotiation. If unresolved, disputes shall be submitted to non-binding mediation prior to initiating litigation. Each party is responsible for its own costs and attorneys' fees unless a court or arbitrator directs otherwise.
