What the Healthcare PACE Agreement Is and What It Covers

The Healthcare PACE Agreement is a written contract used by Program of All‑Inclusive Care for the Elderly (PACE) providers, participants, and authorized representatives to document enrollment terms, covered services, cost sharing, and mutual responsibilities. It records participant eligibility, the scope of medical, social, and long‑term care services, and how Medicare, Medicaid, and other payers coordinate benefits. The agreement also specifies consent for treatment and information sharing, termination and grievance procedures, and the administrative basis for billing, appeals, and program oversight.

Why a Clear Healthcare PACE Agreement Matters

A complete Healthcare PACE Agreement reduces disputes, documents informed consent for care and data sharing, and creates a defensible record for billing and audits. It aligns expectations among participants, caregivers, clinicians, and payers while helping meet federal and state program requirements.

Why a Clear Healthcare PACE Agreement Matters

Who Prepares and Signs a Healthcare PACE Agreement

Typical users who prepare or sign this agreement include program administrators, care coordinators, participants, and legal representatives.

  • PACE program administrators — manage enrollment, service coordination, billing, and regulatory compliance.
  • Participants and family caregivers — review benefits, consent to care, and accept financial responsibilities.
  • Authorized representatives and providers — sign for a participant when a power of attorney or other authorization is in place.

Accurate completion by these parties reduces administrative delays, supports timely care delivery, and strengthens regulatory compliance records.

Key Roles That Sign or Manage the Agreement

Program Administrator

Oversees enrollment, verifies eligibility, coordinates provider network agreements, and ensures the agreement reflects payer coordination rules and organizational policies. Responsible for retaining executed copies and updating terms when program rules change.

Participant Representative

Signs on behalf of a participant when authorized, confirms participant preferences and financial arrangements, and serves as the primary contact for notices, appeals, and care coordination communications.

Essential Data Elements and Short Format Notes

Participant Name: Full legal name
Date of Birth: MM/DD/YYYY
Participant ID: Program identification number
Primary Payer: Medicare/Medicaid indicator
Authorized Rep: Name and authority type
Signature Date: MM/DD/YYYY

Common Legal and Financial Risks to Watch For

Billing Recoupment: Repayment or audit adjustments
Termination Disputes: Service interruption or appeals
Privacy Violations: HIPAA-related enforcement risk
Invalid Signatures: Challenges to enforceability
Incorrect Payer Info: Payment denial or delays
Retention Failures: Regulatory noncompliance penalties

Common Mistakes When Preparing a Healthcare PACE Agreement

  • Using informal names or nicknames instead of the participant’s full legal name, which can mismatch payer records and delay billing.
  • Failing to document an authorized representative’s authority or attach power of attorney, leading to signature challenges during appeals.
  • Omitting explicit consent for PHI sharing and care coordination, which increases exposure to HIPAA compliance issues.
  • Leaving effective dates, renewal terms, or termination notice periods blank, creating ambiguity about when benefits begin or end.

Step-by-Step: Completing a Healthcare PACE Agreement

Follow these sequential steps to complete and execute a Healthcare PACE Agreement correctly, whether on paper or using an electronic platform.

  • 01
Collect participant info: Gather full legal name, DOB, ID, payer details, and emergency contact.
  • 02
Confirm eligibility: Verify PACE eligibility and payer coordination before enrollment.
  • 03
Document services and costs: List covered services, copay amounts, and payment responsibilities.
  • 04
Sign and distribute: Obtain required signatures and deliver executed copies to all parties.

How Agreement Routing and Approvals Typically Work

A typical routing sequence ensures administrative review, clinical sign‑off when required, and final participant or representative signature before enrollment becomes effective.

  • Administrative review: Intake staff validate eligibility, payer and documentation completeness.
  • Clinical review: Care team confirms service plan and clinical approvals.
  • Legal or financial review: Billing team verifies payer coordination and cost sharing.
  • Final signature: Participant or rep signs; executed copy returned to records.

Core Sections to Include in a Professional Healthcare PACE Agreement

A well‑structured Healthcare PACE Agreement organizes enrollment, services, payment, privacy, termination, and dispute resolution into clear, readable sections for participants and administrators.

Enrollment Terms

Describe eligibility criteria, effective date, minimum commitments, and renewal conditions so both parties know when coverage begins and ends.

Covered Services

List medical, social, transportation, and supportive services provided under the PACE program and any service exclusions or limits.

Payment and Coordination

Explain how Medicare, Medicaid, and other payers interact, participant cost sharing, billing responsibilities, and collections procedures.

Privacy and Data Sharing

State consent for treatment and PHI disclosures required for care coordination, and note applicable privacy safeguards.

Termination and Appeals

Set notice periods, reasons for termination, and the internal grievance and external appeals process for disputes.

Signatures and Authorizations

Include signature blocks for participant, authorized representative, and program official plus dates and attestations of authority.

Configuring an Electronic Workflow for the Agreement

When using an eSignature platform, configure fields and routing to match your internal approval steps and legal requirements.
