Services, Care and Responsibilities

Facility Obligations: The facility shall provide residential accommodation, meals, personal care, medication administration per prescriber orders, routine health monitoring, and emergency response as clinically indicated. The facility will provide written notice of any change in services or fees not less than 30 days prior to change unless a change is necessitated by an immediate health or safety concern.

Resident Obligations: The resident shall pay fees when due, provide accurate medical and financial information, comply with facility policies, and notify staff of changes in health status. The resident is responsible for valuables and personal property; the facility maintains no liability for loss except in cases of proven negligence.

Medication Administration: The resident consents to facility staff administering medications as prescribed by a licensed prescriber. Facility will maintain medication records and communicate medication changes to the resident or designated responsible party. For PRN or over-the-counter medications, the resident consents to administration according to facility policy unless written objection is provided.

Fees, Refunds and Liability

Fees are payable by the resident or responsible payer. Failure to pay may result in discharge in accordance with the termination provisions below. Security deposit will be applied to unpaid balances upon termination in accordance with applicable law. Refund of prepaid fees will be calculated according to facility cancellation and discharge policy.

Insurance and Third-Party Billing: The resident authorizes the facility to bill insurance carriers and third-party payers for services provided. The resident remains ultimately responsible for fees not covered by third-party payers.

Termination and Transfer

Term: This agreement continues on a month-to-month basis beginning on the Admission Date shown above until terminated by either party with thirty (30) days' written notice, or immediately by the facility when the resident's clinical needs exceed facility capabilities, when nonpayment occurs, or when safety of the resident or others is jeopardized.

Discharge Planning: The facility will provide reasonable assistance with discharge planning and transfer arrangements when discharge is required. The resident will participate in discharge planning and provide necessary information to facilitate safe transfer.

HIPAA / Privacy Authorization

The resident acknowledges receipt of the facility's notice of privacy practices and authorizes the facility to use and disclose protected health information for purposes of treatment, payment and healthcare operations consistent with that notice. The resident authorizes release of medical records to designated individuals or agencies as necessary for payment, coordination of care, and legal requirements.

Consent and Acknowledgment

By signing below the resident (or legally authorized representative) certifies that all information provided is true and complete to the best of their knowledge; that they understand the services to be provided, the payment obligations, and the facility's policies regarding termination and discharge; and that they consent to the terms of this agreement.

Miscellaneous Provisions

Governing Law and Venue: This agreement will be governed by the laws of the state in which the facility is located. Any dispute arising under this agreement will be resolved in the courts of that state unless the parties agree to alternative dispute resolution in writing.
