What the Healthcare Room and Board Agreement Covers

A Healthcare Room and Board Agreement is a written contract that sets the terms for lodging, meals, and related services provided by a healthcare or residential care facility to a patient or resident. It defines financial responsibilities, daily services, room type, length of stay, admissions and discharge processes, and how third‑party payers and personal payments are handled. The agreement also addresses privacy, billing practices, and dispute resolution so both provider and resident understand obligations before services begin.

Why a Clear Room and Board Agreement Matters

A precise agreement reduces billing disputes, clarifies responsibilities, and documents consent for services and charges. For healthcare settings, it also helps align patient privacy and insurance coordination with operational procedures.

Why a Clear Room and Board Agreement Matters

Who Typically Drafts and Signs This Agreement

Common participants include facility administrators, patients or residents, family representatives, and payer-authorized agents.

  • Facility administrators and billing teams responsible for rates and policies.
  • Patients or authorized family members providing consent and payment authorization.
  • Third-party payers or case managers coordinating coverage and preauthorization.

Roles vary by facility type; ensure the person signing has legal authority to bind the resident and to provide payment authorizations.

Essential Elements Found in a Professional Agreement

A comprehensive agreement balances operational clarity and legal protections, covering services, costs, privacy, timelines, and dispute resolution in plain language.

Services Included

A clear list of lodging, meal plans, housekeeping, nursing support, and any ancillary services included in the room and board fee.

Charges & Billing

Rate schedule, billing frequency, deposit requirements, whether charges are bundled or itemized, and how insurance payments will be applied.

Insurance Handling

Instructions for insurance claims, assignment of benefits, patient responsibility if payer denies coverage, and preauthorization obligations.

Privacy & PHI

A statement about protected health information handling consistent with HIPAA and any facility-specific privacy addenda or BAAs.

Admission / Discharge

Criteria for admission, expected length of stay, discharge notice requirements, and responsibilities at termination or transfer.

Legal Terms

Governing law, dispute resolution method, amendment procedures, and signature blocks for parties and witnesses or notary where required.

  • Failing to obtain proper signature authority, leaving the agreement unenforceable against insurers or third parties.
  • Neglecting to attach required privacy addenda (BAA) when PHI will be sent to business associates.
  • Omitting payment authorization details, which can prevent timely collection of resident responsibility amounts.
