What the High Deposits LOX Agreement Is and When It’s Used

A High Deposits LOX Agreement is a written Letter of Explanation used to document and verify atypically large deposits in a borrower’s account when applying for credit or completing a real estate closing. Lenders and underwriters request it to confirm the lawful source of funds, describe the transaction, and attach supporting evidence such as bank statements, gift letters, or transfer records. The form preserves a clear record of the depositor’s representations, reduces underwriting delays, and supports compliance with lender policies and anti‑money‑laundering checks.

Why a Clear LOX Matters for Underwriting and Compliance

A complete High Deposits LOX Agreement clarifies source-of-funds questions, expedites underwriting, and documents facts for audit trails required by lenders and regulators such as AML guidelines and investor overlays.

Why a Clear LOX Matters for Underwriting and Compliance

Who Prepares and Who Receives a High Deposits LOX

Typical participants involved before, during, and after submission.

  • Borrowers — provide explanation, attach bank statements, and attest to accuracy for underwriting review.
  • Loan officers — collect the LOX, confirm attachments, and forward to underwriting with loan file.
  • Underwriters — evaluate source-of-funds evidence, seek clarifications, and document final loan eligibility determinations.

Who Prepares and Who Receives a High Deposits LOX

Roles vary by institution, but accuracy and timely submission reduce rework and conditional approvals.

Primary Signatories and Stakeholders

Loan Officer

Loan Officer — Mortgage originator who requests the LOX from the borrower, confirms supporting documents, and ensures the explanation is included in the loan file for underwriting and investor review.

Underwriter

Underwriter — Loan reviewer who assesses the explanation and attachments, applies investor or agency overlays, documents acceptability or exceptions, and records conclusions in the loan decision notes.

  • Unsigned LOX forms, unsigned attachments, or failure to include an attestation or signature block.

  • Verification: Underwriting matches deposits to source documentation.
  • Retention: LOX and evidence stored in loan file per retention rules.
