HOLIDAY RENTAL AGREEMENT

This Holiday Rental Agreement (the "Agreement") is made and entered into as of Date: by and between Owner Name: (the "Owner") and Renter Name: (the "Renter").

RECITALS

WHEREAS, Owner is the lawful owner or authorized agent of the short-term rental property described above and has authority to offer the property for temporary holiday occupancy; and

WHEREAS, Renter desires to rent the Property for a limited holiday period and Owner is willing to rent the Property to Renter on the terms and conditions set forth herein; and

WHEREAS, the parties intend for this Agreement to define their rights and obligations with respect to the rental, security, use, and return of the Property for the rental term established below.

NOW, THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the parties agree as follows:

1. TERM; OCCUPANCY

1.1 Rental Term. The rental term (the "Term") shall commence on at and shall end on at unless earlier terminated in accordance with this Agreement.

1.2 Occupancy Limit. Maximum permitted occupancy is persons. Renter shall not permit more than the stated number of persons to occupy the Property without Owner's prior written consent.

2. RENT; CHARGES; PAYMENTS

2.1 Rent. Renter shall pay to Owner a total rental amount of $ (the "Rent").

2.2 Security Deposit. Renter shall deliver a security deposit in the amount of $ to secure Renter's performance. Owner may use the deposit for unpaid Rent, cleaning, repair of damage beyond normal wear and tear, and other breaches. Owner will return any balance of the security deposit to Renter within days after the end of the Term, together with an itemized statement of deductions.

3. SECURITY, KEYS, AND ACCESS

3.1 Keys and Access. Owner will provide keys or access codes to Renter. Renter shall not change locks or security devices without Owner's prior written consent. Owner or Owner's agent may enter the Property upon reasonable notice to make repairs, inspect for compliance, or in an emergency; notice is not required in the case of emergency.

4. USE, MAINTENANCE, AND PROHIBITED CONDUCT

4.1 Permitted Use. The Property shall be used solely for temporary residential holiday accommodation. Renter shall comply with all laws, neighborhood rules, and any condominium or homeowner association regulations applicable to the Property.

4.2 Prohibited Activities. No commercial events, parties that exceed occupancy limits, illegal activity, or excessive noise likely to disturb neighbors are permitted. Smoking inside the Property is allowed prohibited (check applicable box). Renter is responsible for any fines or penalties resulting from prohibited conduct.

4.3 Pets. Pets are allowed prohibited (check applicable box). If pets are allowed, additional pet deposit and rules shall apply as set forth in this Agreement.

5. MAINTENANCE; DAMAGE; INSPECTION

5.1 Renter Obligations. Renter shall keep the Property in a clean and sanitary condition, remove all personal property and trash at the end of the Term, and promptly notify Owner of any damage or defects.

5.2 Owner Remedies. If Renter fails to comply with maintenance obligations, Owner may undertake repairs at Renter's expense and deduct costs from the security deposit. Renter shall be liable for repair or replacement costs for damage beyond normal wear and tear.

5.3 Inventory. An inventory and condition checklist shall be attached hereto or completed at check-in. Renter's signature on the checklist constitutes conclusive evidence of condition unless Owner provides notice of additional defects within days after check-out.

6. CANCELLATION; TERMINATION

6.1 Cancellation by Renter. If Renter cancels prior to , deposit shall be refunded subject to any non-refundable booking fees. Cancellations made within days of the Term may forfeit the security deposit and any payments made, unless otherwise agreed in writing.

6.2 Termination for Breach. Owner may terminate this Agreement and require immediate vacatur if Renter materially breaches any provision, including occupancy limits or unlawful conduct. Termination shall not limit Owner's right to recover damages.

7. INSURANCE; INDEMNIFICATION

7.1 Insurance. Renter acknowledges that Owner's property insurance may not cover Renter's personal property or liability. Renter is encouraged to obtain appropriate travel or renter insurance to cover personal property loss and liability.

7.2 Indemnification. Renter shall defend, indemnify and hold harmless Owner, Owner's agents and employees from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of Renter's use of the Property, breach of this Agreement, or negligent or willful acts of Renter or Renter's invitees.

8. DEFAULT; REMEDIES

8.1 In the event of default by Renter, Owner may pursue any remedy available at law or equity, including retention of all or part of the security deposit, recovery of unpaid Rent, and injunctive relief. Renter shall be responsible for Owner's costs of collection, including reasonable attorneys' fees.

9. FORCE MAJEURE

9.1 Neither party shall be liable for failure to perform obligations under this Agreement to the extent such failure is caused by events beyond the reasonable control of the affected party, including acts of God, natural disasters, governmental action, epidemics, or other unforeseeable events. The parties shall negotiate in good faith a fair resolution, but this clause does not excuse Renter's obligation to pay sums due for periods already fully performed.

10. NOTICES

10.1 All notices under this Agreement shall be in writing and delivered personally, by certified mail (return receipt requested), or by another method providing proof of delivery, to the addresses provided above. Notice shall be deemed given upon receipt.

11. MISCELLANEOUS

11.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Property is located, without regard to choice of law principles.

11.2 Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, understandings, and agreements, whether written or oral.

11.3 Amendments. Any modification or amendment to this Agreement must be in writing signed by both parties to be effective.

11.4 Waiver. The failure of either party to insist upon strict performance of any provision of this Agreement shall not be deemed a waiver of that provision or any other provision.

11.5 Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

11.6 Counterparts. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument. Facsimile or electronic copies of signatures shall be binding.
