Parties and Project Identification

Builder Name:    Builder Contact:

Homeowner Name:    Homeowner Contact:

Contract/Project No.:    Date of Substantial Completion:

WHEREAS

WHEREAS, Builder has constructed or substantially completed improvements to the Property identified above in accordance with the construction contract between Builder and Homeowner; and

WHEREAS, Builder warrants certain aspects of the improvements against defects in materials and workmanship for the periods and subject to the terms set forth below; and

WHEREAS, Homeowner seeks the protections of this limited warranty and agrees to the obligations and procedures for notice and repair set forth in this document.

Scope of Work (Warranty Coverage)

The warranty covers defects in materials and workmanship performed by Builder in the construction of the improvements at the Property. Specific systems and components covered and excluded are set forth below. Repairs performed under this warranty shall be limited to correction of defects and shall not include cosmetic changes unrelated to defect correction.

Warranty Periods

Builder warrants workmanship and materials as follows unless otherwise specified in writing: workmanship and materials — 1 year from substantial completion; mechanical, electrical and plumbing systems — 2 years from substantial completion; structural load-bearing elements — 10 years from substantial completion. These time periods run from the Date of Substantial Completion provided above.

Any exceptions or extended periods must be set forth in writing and attached as an addendum to this form.

Claims, Notice and Remedy

Homeowner must provide written notice of a claimed defect to Builder within a reasonable time after discovery. Notice must describe the defect with reasonable particularity and provide access to the Property for inspection and repair. Builder shall inspect the claimed defect within a commercially reasonable time and, if the defect is covered, shall elect to repair or replace the defective component at Builder's expense.

Payment Terms (for Out-of-Warranty or Non-Covered Work)

Covered warranty repairs will be performed at Builder's expense. For repairs that are not covered by this warranty (including those due to homeowner neglect, misuse, alteration, or normal wear and tear), Homeowner agrees to payment on the following terms:

Term and Termination

This warranty becomes effective on the Date of Substantial Completion and continues for the periods set forth in the Warranty Periods section unless earlier terminated as provided below.

Termination: Builder may terminate obligations under this warranty for nonpayment of agreed charges for non-covered repairs, or for material breach by Homeowner if Homeowner fails to cure within the notice period below.

Homeowner Obligations and Maintenance

Homeowner shall perform routine maintenance as recommended by manufacturers and Builder and shall take reasonable steps to mitigate damage after discovery of a defect. Failure to perform routine maintenance that is a proximate cause of a defect shall void coverage for that defect.

Confidentiality

Except as required by law or as necessary to effect repairs under this warranty, the parties agree to treat the terms of this warranty and any proprietary construction methods disclosed in connection with warranty performance as confidential. Neither party shall disclose confidential information of the other without prior written consent.

I acknowledge and agree to the confidentiality obligations stated above.

Limitation of Liability

Except as expressly provided in this warranty, Builder makes no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Builder's liability under this warranty is limited to repair or replacement of defective work or materials and in no event shall Builder be liable for consequential, incidental, punitive or special damages.

Governing Law; Entire Agreement; Severability

This warranty shall be governed by the laws of the state in which the Property is located. This document, including any attached addenda, constitutes the entire agreement between Builder and Homeowner with respect to the subject matter herein and supersedes prior oral or written representations. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

What the Home Builders Warranty Form Covers

A Home Builders Warranty Form is a written warranty issued by a builder that records the scope, duration, and conditions of post-completion coverage for a newly constructed or substantially renovated home. It typically defines covered components (workmanship, systems, and structural elements), exclusions, homeowner notice requirements for claims, remedies available to the homeowner, and any transfer or assignment rules for future owners.

Why a Clear Warranty Form Matters

A well-drafted Home Builders Warranty Form reduces disputes, clarifies obligations for both parties, and sets predictable timelines for inspections and repairs. It protects builder liability and helps homeowners understand how and when to report defects.

Why a Clear Warranty Form Matters

Primary Parties Who Use This Form

Common users include the parties responsible for creating, receiving, and administering the warranty.

  • Home builders and general contractors providing coverage for new construction or major renovations.
  • Homeowners or buyers who need documented warranty terms and claim procedures.
  • Warranty administrators, escrow agents, and title companies managing transfer or records.

Each user needs clearly completed fields and properly executed signatures to preserve enforceability and ease claim handling.

Core Elements to Include in a Professional Warranty Form

A thorough warranty form divides coverage by topic, sets precise time limits, and provides an actionable claim process to reduce ambiguity.

Scope of Coverage

Define workmanship, mechanical systems, and structural coverage clearly, including what is excluded and any conditional limitations.

Duration Terms

Specify exact warranty periods for each coverage category (for example, one-year workmanship, two-year systems, ten-year structural) and note state variations.

Claim Procedure

Describe how to provide written notice, required evidence, inspection scheduling, and expected response times from the builder.

Remedies Available

State repair, replacement, or monetary remedies, who will perform work, and whether the builder controls contractor selection.

Transferability

Indicate whether the warranty transfers on sale, any assignment conditions, and whether transfer fees apply.

Limitations and Exclusions

List common exclusions such as normal wear, improper maintenance, alterations by owner, and consequential damages limits.

Typical Warranty Timelines and Deadlines

Warranty periods and notice deadlines vary by contract and jurisdiction; the entries below reflect common industry practices.

Effective and Start Date:

Warranty often begins on final completion or certificate of occupancy.

One-Year Workmanship:

Commonly 12 months for general workmanship and finishes.

Two-Year Systems:

Often covers plumbing, electrical, and mechanical systems for two years.

Ten-Year Structural:

Many builders provide a ten-year limited structural warranty for major defects.

Claim Notice Deadline:

Require written notice promptly; contracts often set specific notice windows.

Common Preparation Errors to Avoid

  • Failing to enter the effective date or entering conflicting dates that create ambiguity about when coverage begins.
  • Using vague language for coverage or remedies, which increases the likelihood of disputes or litigation.
  • Omitting required signatories or using unsigned copies, which can undermine enforceability and claims processing.
  • Neglecting to attach required exhibits (plans, punch lists, or maintenance instructions) that define scope and homeowner duties.

Consequences of an Incorrect or Incomplete Form

Void Warranty: Imprecise terms or missing signatures can void coverage
Claim Denial: Improper notice procedures may be grounds to deny a claim
Financial Liability: Unclear remedy language can increase repair or litigation costs
Title Issues: Failure to document transferability can complicate future sales
Regulatory Risk: Noncompliance with state consumer protection laws risks penalties
Recordkeeping Gaps: Poor retention hinders defense of later warranty disputes

Illustrative Scenarios Using a Warranty Form

Two brief examples show how warranty forms are applied in real-world construction and sale contexts.

New Construction Project

A builder issues a one-year workmanship warranty at closing to the buyer

  • The homeowner documents defects and submits written notice within the contract timeframe
  • Prompt repair coordination and a retained signed copy reduced follow-up disputes during the first-year warranty period.

Resale Transfer

A homeowner sells the property three years after completion; the warranty permits assignment to the buyer

  • The seller submits a transfer notice and required fee per contract
  • Clear transfer language allowed the buyer to pursue remaining structural coverage without title delays at closing.

Practical Tips for Accurate and Efficient Completion
