What the HomeStream Client Agreement Covers

The HomeStream Client Agreement is a written contract between HomeStream (the service provider) and a client that defines the scope of home-related services, client responsibilities, fees and payment schedule, performance timelines, termination rights, confidentiality, intellectual property ownership, indemnification, limitation of liability, notices, and governing law. The agreement creates binding obligations once executed by authorized signatories; it typically includes signature blocks and may allow electronic signatures and secure eSubmission methods where permitted by applicable law.

Why a Clear Client Agreement Matters

A HomeStream Client Agreement documents expectations, payment terms, and remedies, reducing dispute risk and clarifying deliverables. It also establishes legal recourse, preserves evidence for audits or claims, and supports compliant electronic execution under U.S. e-signature law.

Why a Clear Client Agreement Matters

Who Typically Signs or Completes This Agreement

Typical parties who sign or complete a HomeStream Client Agreement include homeowners, property managers, and service providers engaged in home-related services.

  • Homeowners and tenants seeking defined services, timelines, warranties, and payment clarity for a single property.
  • Property managers and real estate brokers coordinating multiple contractors, invoicing, and centralized notices across portfolios.
  • Independent contractors and service firms who require explicit scope, indemnity, and payment terms before beginning work.

Use the agreement consistently across projects to align responsibilities and preserve a clear contract record suitable for electronic signing and later review.

Core Elements to Include in a Professional Agreement

A professional HomeStream Client Agreement groups the principal clauses so obligations, remedies, and execution mechanics are explicit and enforceable.

Scope of Services

Describe tasks, deliverables, milestones, locations, and any excluded services in precise language so scope disputes are minimized and expectations are enforceable.

Payment and Fees

Define fees, due dates, invoicing cycles, late-payment interest, and any retainers or milestone payments so cash flow and remedies for missed payments are clear.

Term and Termination

State effective date, contract duration, renewal terms, and termination for convenience or cause, plus notice periods and post-termination obligations.

Confidentiality & IP

Protect sensitive client data and define ownership or assignment of intellectual property created in the engagement, including permitted uses and exceptions.

Liability & Indemnity

Limit monetary exposure where lawful, allocate responsibility for third-party claims, and include insurance requirements when appropriate for the services provided.

Notices & Governing Law

Specify the governing state law, notice addresses, and dispute-resolution method (mediation, arbitration, or courts) so procedural expectations are set.

Step-by-Step: Complete and Execute the Agreement

How to Configure an Online Signing Workflow

When you set up an eSignature workflow, configure authentication, conditional fields, reminders, and storage to match legal and internal requirements.

Document Field and Configuration Options Set fields as required, apply conditional visibility, and include read-only text for key notices.
Signer Authentication Settings and Options Choose email link, SMS code, or stronger options like KBA or SSO depending on risk and regulatory needs.
Template and Conditional Field Rules Use templates to reuse core clauses and conditional fields to show only relevant terms to each signer.
Bulk Send and Reminder Schedule Schedule automatic reminders, and use bulk send for identical agreements to many recipients when supported.
Storage Location and Retention Policy Configure secure cloud storage, export formats, and retention timelines consistent with recordkeeping policies.

Digital Signing and eSubmission Considerations

Configure your signing platform to preserve audit trails, support required authentication, and export signed documents in standard formats.

  • Supported Formats: PDF, DOCX, and fillable form exports.
  • Authentication Modes: Email links, SMS codes, KBA, SSO options.
  • Integrations: Salesforce, NetSuite, Google Workspace, and cloud storage.

Confirm the vendor supports encryption in transit and at rest, audit trail export, and any required compliance controls (for example HIPAA BAA if handling PHI). Retain certificates of completion and signer consent records alongside stored agreements for evidentiary purposes.

Where to Send or Submit the Executed Agreement

After execution, route the signed HomeStream Client Agreement to internal systems and external parties using these common destinations.

  • HomeStream Portal: Upload the signed copy to the client record for operational access.
  • Client Email: Send a PDF copy to the client and their authorized contacts.
  • CRM or ERP Upload: Attach the executed agreement to Salesforce or NetSuite records.
  • eSignature Provider: Store the certificate of completion and signed PDF in the eSignature account.

Common Timeframes and Notice Periods

Typical deadlines in the HomeStream Client Agreement relate to payment, cure periods, notice, and renewal timing.

Payment Due Date:

Commonly Net 30 days from invoice delivery.

Cure Period for Breach:

Often 10–30 days to cure before termination rights arise.

Termination Notice:

30 days is a frequent notice period for termination for convenience.

Renewal Window:

Automatic renewal clauses usually require notice 30–60 days before term end.

Response Time for Notices:

Designate 7–14 business days for written notice responses.

Common Preparation and Execution Mistakes to Avoid

  • Using vague scope language that leads to disagreements about deliverables and additional work costs several times the cost of a precise exhibit.
  • Failing to match signer names to government IDs or business formation documents, which can delay enforcement and create signature disputes.
  • Omitting payment mechanics (how to pay, where to send funds) resulting in late payments and collection expenses.
  • Relying on informal email approvals without a signature block or audit trail; such evidence is weaker if a dispute goes to litigation.

Consequences of Incomplete or Incorrect Agreements

Breach Liability: Monetary damages and legal costs.
Enforceability Risk: Ambiguous terms may render clauses unenforceable.
Tax Consequences: Incorrect payment reporting may trigger penalties.
Data Exposure: Poor privacy controls risk regulatory fines.
Notarization Failure: Missing notary/witness can invalidate specific instruments.
Contractual Disputes: Costly arbitration or litigation.

Full Legal Name: Client or business name.
Service Address: Street, city, state, ZIP.
Payment Details: Bank, ACH, or card terms.
Effective Date: MM/DD/YYYY format.
