What a Hotel Stay Agreement Covers

A Hotel Stay Agreement is a written contract between a lodging operator and a guest that sets the terms for occupancy, payment, deposits, cancellation, guest conduct, liability for damage, and checkout procedures. It documents rates, dates, identification requirements, and any special conditions such as pet policies or early-departure fees. When executed properly it reduces disputes and clarifies responsibilities for both parties. Electronic execution is generally permitted under the ESIGN Act (15 U.S.C. ch. 96) and state UETA laws; exceptions and local consumer-protection rules can apply.

Why a Clear Agreement Matters for Hosts and Guests

A Hotel Stay Agreement protects both parties by documenting charges, accepted payment methods, cancellation policies, and liability limits. Clear terms reduce disputes, support tax and regulatory compliance, and provide a defensible record if claims arise.

Why a Clear Agreement Matters for Hosts and Guests

Who Typically Prepares and Signs a Hotel Stay Agreement

Hotels, motels, vacation rental managers, and property owners use this agreement to set occupancy terms and collect consent from guests.

  • Hotel operators and property managers
  • Individual guests and group bookers
  • Corporate travel departments and agencies

Guests, corporate bookers, travel agents, and authorized payment delegates will commonly sign or authorize the agreement depending on the booking channel used.

  • Omitting local tax or licensing requirements for transient occupancy, which can lead to fines or audit adjustments.
  • Failing to capture accurate guest identification and consent, increasing risk of identity disputes at check-in.
  • Not preserving the full audit trail for electronic signatures, making it harder to prove execution and intent.

Consequences of an Incorrect or Incomplete Agreement

Deposit Forfeiture: Guest may lose deposit
Chargebacks: Payment disputes and fees
Local Fines: Occupancy tax penalties
Civil Claims: Breach-of-contract lawsuits
Privacy Fines: HIPAA or consumer-privacy penalties
