HOUSING ASSISTANCE SECTION 8 AGREEMENT

This Housing Assistance Agreement (the Agreement) is entered into on by and between:

WHEREAS

WHEREAS, the Housing Authority administers federal rental assistance under the Housing Choice Voucher program commonly referred to as Section 8 and has authority to make housing assistance payments on behalf of qualified participants; and

WHEREAS, the Owner is the lawful owner or authorized agent of the dwelling unit identified below and is willing to enter into this Agreement to accept housing assistance payments under program requirements; and

WHEREAS, the parties desire to set forth their respective obligations, payment terms, and remedies with respect to the assisted tenancy for the tenant named in this Agreement.

The Owner agrees to provide and maintain the Unit in accordance with applicable housing quality standards, local housing codes, and the terms below. Late Payment: If the Housing Authority fails to make a HAP payment when due through no fault of the Owner, interest shall accrue at on the overdue amount. The Owner's remedies for missed payments are limited to those expressly provided under this Agreement and controlling program rules.

Either party may terminate this Agreement for material breach, failure to maintain the Unit in accordance with applicable standards, or other cause permitted by program rules. Termination for convenience by either party requires written notice of days to the other party. Termination for cause may be effective immediately where immediate action is required to protect tenant health and safety; otherwise, the breaching party shall be afforded a reasonable cure period consistent with program requirements.

CONFIDENTIALITY

The parties shall maintain the confidentiality of tenant records and program data in accordance with applicable privacy laws and program regulations. Confidential information shall not be disclosed except as required by law, pursuant to court order, or as necessary to administer benefits under this Agreement. The Housing Authority may disclose information to authorized program personnel and inspecting agents.

OWNER REPRESENTATIONS, COMPLIANCE, AND WARRANTIES

The Owner represents and warrants that: (a) Owner has legal authority to enter into this Agreement for the Unit; (b) the Unit complies with applicable housing quality standards and local code requirements; (c) Owner will comply with all applicable federal, state, and local fair housing and anti-discrimination laws; and (d) Owner has disclosed to the Housing Authority all known lead-based paint hazards and other material defects.

INSPECTION, MAINTENANCE, AND REPAIRS

The Housing Authority or its authorized representatives may inspect the Unit to verify compliance with housing quality standards. The Owner shall promptly make repairs required to maintain compliance. Failure to correct deficiencies within reasonable timeframes established by the Housing Authority may result in abatement of HAP payments and termination of this Agreement.

INDEMNIFICATION

Each party shall indemnify and hold harmless the other from liabilities, damages, losses, costs, and expenses arising from their own willful misconduct, breach of this Agreement, or negligence. The Housing Authority's liability for any claim arising under this Agreement shall be limited to available program funds and as provided by applicable law.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to conflicts of law principles.

ENTIRE AGREEMENT

This Agreement, together with any attachments, addenda, and the relevant program regulations and the tenant lease incorporated herein by reference, constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior discussions and agreements. No amendment to this Agreement shall be effective unless in writing and signed by both parties.

All notices required or permitted under this Agreement must be in writing and delivered to the contact address provided below or to another address designated in writing by a party. Notices are effective upon receipt.
