What the Housing Counseling Agreement Is

A Housing Counseling Agreement is a written contract between a housing counselor or counseling agency and a client that records the scope of counseling services, fees (if any), confidentiality expectations, and the client’s consent to receive counseling. It typically documents the counselor’s role, timing and format of sessions, required disclosures, and any third parties (lenders, servicers) who may receive summary information. For HUD-approved counseling, the agreement also supports program reporting and demonstrates that informed consent and counseling objectives were provided and accepted by the client.

Why a Clear Agreement Matters

A formal Housing Counseling Agreement clarifies responsibilities, protects client privacy, and documents consent to share information with lenders or housing programs. It reduces misunderstandings that can delay loan modifications, loss mitigation, or program enrollment.

Why a Clear Agreement Matters

Who Typically Completes the Agreement

Housing counselors, HUD-approved agencies, mortgage servicers, and clients all use this agreement to set expectations and document consent before counseling begins.

  • HUD-approved counseling agencies and nonprofits providing pre-purchase, foreclosure prevention, or rental counseling.
  • Mortgage servicers and lenders that request certified counseling summaries to support loss mitigation or underwriting.
  • Individual clients seeking housing guidance, benefit eligibility assistance, or debt and budgeting support.

The document provides a consistent record needed for program reporting, potential third-party review, and retention under applicable recordkeeping rules.

Step-by-Step: Completing the Housing Counseling Agreement

Follow these steps to prepare, review, and finalize the agreement so it is complete, attributable, and retained according to applicable rules.

  • 01
Prepare document: Populate names, effective date, scope, and disclosures before sending for signature.
  • 02
Review with client: Walk through disclosures and data-sharing consent during the counseling session.
  • 03
Capture signature: Obtain client signature (wet or electronic) and counselor signature with timestamps.
  • 04
Store record: Save the signed agreement to the agency record and follow retention rules.

Essential Sections to Include in a Professional Agreement

A robust Housing Counseling Agreement should be organized, complete, and explicit about services and privacy. Include sections that address roles, consent, fees, confidentiality, dispute resolution, and record retention.

Parties

Identify client(s) and counseling agency by legal name and contact information.

Services

Define counseling scope, session format (phone/virtual/in-person), and expected deliverables.

Fees and Payment

State any fees or indicate services are free; include refund or cancellation terms if applicable.

Confidentiality

Describe privacy protections and any permitted disclosures to lenders, HUD, or third parties.

Consent to Share

Obtain client consent for summaries, verifications, and third-party communication.

Signatures and Dates

Provide dated signature blocks for client and counselor; note witness or notary requirements if required.

Security and Compliance Essentials for Records

Encryption in transit: TLS 1.2/1.3
Encryption at rest: AES-256
HIPAA readiness: BAA required for PHI
Audit trails: Timestamp and action logs
Certifications: SOC 2 Type II
Accessibility: WCAG 2.0 Level AA

Configuring an Electronic Workflow

Set up fields, authentication, and routing rules so signatures are attributable and the execution path is auditable.

Field Configuration
Signature Field Require signer name, signature, and date
Authentication Email link or SMS code for signer verification
Conditional Fields Show payment fields only if fees apply
Routing Sequential signers: client then counselor

Where to Send or File the Completed Agreement

After execution, deliver copies to all parties and route program-specific copies to the entities that require them.

  • Client copy: Signed PDF delivered to the client via secure email
  • Agency file: Store signed record in the agency case file
  • Lender or servicer: Send summary with client consent if requested
  • HUD reporting: Provide required data elements to program systems

Digital Signing and Integration Considerations

Choose a platform that preserves an audit trail, supports required security controls, and exports standard PDF records.

  • File formats: PDF, DOCX supported
  • Integrations: Salesforce, Microsoft 365, NetSuite
  • Mobile support: Desktop and mobile signing

Timing and Typical Deadlines to Track

Monitor dates that determine rights, reporting, and follow-up so counseling outcomes and any downstream lender actions stay on schedule.

Counseling date recorded:

Enter the date session occurred for program reporting

Effective date:

The date obligations and consent begin

Document submission:

Send summaries to lenders promptly, often within 30 days

Follow-up appointments:

Schedule client follow-up within timeframe agreed in the plan

Retention start:

Retention periods begin from creation or effective date

Key Milestones from Intake to Retention

Track milestone stages to ensure counseling is documented, consented, and preserved for reporting and compliance purposes.

01

Intake and Consent

Client completes intake, consents to counseling and data sharing

02

Counseling Session

Deliver counseling and document recommendations or referrals

03

Execution of Agreement

Both parties sign and date the agreement

04

Record Retention

Store final signed record per retention rules

Common Preparation Errors to Avoid

  • Using informal or incomplete consent language that fails to document third-party sharing permissions, which can delay lender processing and program reporting.
  • Entering mismatched or abbreviated names and addresses that impede identity checks, cause tax reporting errors, or prevent verification by servicers.
  • Omitting signature dates or using undated signatures which can create ambiguity about when obligations and deadlines began.
  • Attaching unsigned exhibits or failing to include required disclosures that undercut compliance with HUD or program rules.

Consequences of an Incorrect or Incomplete Agreement

Invalid Consent: May render data-sharing unlawful
Delayed Assistance: Lenders may delay loss mitigation
Regulatory Exposure: Noncompliance with HUD or privacy laws
Audit Issues: Missing records hinder audits
Reputational Risk: Client trust may be damaged
Legal Challenge: Signatures or scope disputes may arise

Use Cases: How Agencies Apply the Agreement

Real-world examples show how the agreement supports counseling, lender coordination, and program compliance.

Nonprofit Foreclosure Counseling

A housing agency executes the agreement before a counseling session to document consent and scope.

  • The counselor obtains client authority to share a counseling summary with the servicer.
  • The signed agreement enabled timely submission of documentation leading to an approved loss-mitigation plan and complete program reporting to HUD.

Homebuyer Education

An agency uses the agreement when delivering pre-purchase classes and individualized counseling.

  • Clients consent to data sharing for lender pre-approval checks.
  • Signed agreements provide proof of education completion required by some down-payment assistance programs and streamline lender verification.

Practical Tips for Accurate and Efficient Completion

Adopt standardized templates, consistent fields, and verification steps to reduce rework and support compliance.

Standardize templates across programs
Use a single, reviewed template for all counseling types to ensure consistent disclosures, required fields, and signature blocks. Standard templates reduce reviewer time and minimize the chance of missing program-specific language.
Verify identity and consent
Confirm client identity using government ID or secure electronic authentication and record affirmative consent to electronic records where consumer-facing protections apply under 15 U.S.C. §7001.
Attach supporting exhibits
Include debt schedules, income documentation, and referral forms as exhibits to prevent later disputes about the counseling scope or recommendations provided during the session.
Automate storage and retention
Configure your document management system to archive final signed PDFs with metadata (dates, signer emails, audit trail) and apply retention rules to support audits and regulatory requests.
