What the Identity Verification Attestation Is and When it Applies

The Identity Verification Attestation is a signed declaration that documents how a signer’s identity was confirmed for a specific transaction, record, or filing. It records the identity evidence reviewed (for example, government ID type and number), the verification method used (in-person, remote online notarization, credential analysis, knowledge-based questions), the date of verification, and the person or technology that performed the check. Organizations use the attestation to prove due diligence, support compliance reviews, and create an auditable trail linking identity proofing to the executed record.

Why an Identity Verification Attestation Matters

An attestation reduces identity-related disputes, supports regulatory compliance, and creates an evidentiary record tying signer identity to the transaction. It helps demonstrate reasonable steps to verify identity under ESIGN and UETA frameworks and supports audit and forensic review when disputes or regulatory inquiries arise.

Why an Identity Verification Attestation Matters

Who Typically Completes or Receives this Attestation

The Identity Verification Attestation is used by parties who must document how signers were identified and authenticated before execution.

  • Real Estate professionals verifying tenant or buyer identity during lease or closing workflows.
  • Healthcare administrators documenting patient identity checks for consent and HIPAA compliance.
  • Financial services and lenders confirming identity for KYC, payments, or account-opening processes.

Use cases span internal compliance teams, external notaries, signers, and any legal or audit function that needs a clear record of the identity proofing steps performed.

Core Elements of a Professional Identity Verification Attestation

A complete attestation includes structured items that link the identity check to the signer and the signed record; consistency and clarity help preserve evidentiary value.

Signer Identity

Full legal name, date of birth, and contact details matching government-issued identity documents; these fields must match supporting ID exactly to avoid challenges.

ID Evidence

Type of ID presented (passport, driver’s license), issuing jurisdiction, ID number or truncated identifier, and expiry date when applicable.

Verification Method

Describe how identity was verified—in-person visual inspection, RON with A/V recording, credential analysis, KBA, or third-party identity provider—and note any multifactor checks.

Verifier Information

Name, title, organization, or system identity (API provider) that performed the verification, plus the verifier’s authority (notary, agent, platform).

Verification Date

The exact date and time of identity verification, recorded as MM/DD/YYYY and time where possible to create an auditable timestamp.

Linked Transaction

Reference to the signed document (title, file ID or transaction number) so the attestation is plainly associated with the executed record.

Required Data Elements at a Glance

Full Legal Name: Exact name on government ID
Date of Birth: MM/DD/YYYY
Government ID: Type and truncated number
Verification Method: In-person | RON | Credential check
Verification Date: MM/DD/YYYY
Verifier ID: Name or system identifier

Step-by-Step: Completing an Identity Verification Attestation

Follow these steps in order to create a clear, auditable attestation that links identity evidence to the executed document.

  • 01
Prepare Document: Open the signed record and identify the transaction ID or file name to reference in the attestation.
  • 02
Gather ID: Collect the signer’s government ID and record the document type and issuing jurisdiction.
  • 03
Select Method: Choose the verification method used and note any multifactor checks performed.
  • 04
Sign and Store: Have verifier sign the attestation, timestamp it, and link it to the signed record in your document system.

How to Configure an Online Attestation Workflow

When automating the attestation, configure fields and authentication so every signing event captures the same structured data.

Field Configuration
Authentication Method Choose Email, SMS OTP, KBA, or SSO depending on risk level
Field Types Use required text fields, date pickers, dropdowns for ID type, and read-only transaction IDs
Conditional Logic Show additional fields when RON or third-party checks are selected
Audit Trail Enable detailed logging: IP, timestamp, action history, and verification evidence

Technical Considerations for Digital Signing and eSubmission

Choose a platform that supports required authentication, audit trails, and secure export of both the signed record and the attestation.

  • Authentication: Support for SMS/OTP, KBA, or SSO depending on verification needs
  • Audit Trail: Capture IP, timestamps, and action logs for legal defensibility
  • File Formats: Export signed PDFs with embedded verification metadata (PDF, DOCX supported)

Integrations with document management and storage solutions help ensure the attestation and signed record remain linked and retrievable for audits or regulatory requests.

Typical Routing: Where to Send or File the Attestation

An attestation should be stored with the signed record and made available to compliance, legal, and audit teams; different submission paths apply depending on industry and transaction type.

  • Internal Records: Attach the attestation to the signed file in your DMS or contract repository for permanent retention
  • Regulatory Filing: Include the attestation when a regulator requires identity proof for the transaction or when filing supporting documentation
  • Third-Party Providers: Send verification evidence to KYC/identity vendors or notary services as required
  • Signer Copy: Provide the signer with a copy of the attestation when consumer-facing disclosures are required

Timelines and Processing Expectations

Timeframes differ by use case; document the verification date and retain recordings or logs according to legal or industry retention requirements.

Immediate Verification:

Perform identity checks before executing the primary agreement to avoid later challenges

RON Recording Retention:

Keep audio-video recordings for the period required by the state RON rules

Processing Time:

Credential-analysis or third-party checks typically complete within minutes to a few hours

Audit Availability:

Ensure logs are exportable and readable within standard audit windows

Request Response:

Provide attestation copies to authorized parties within organization SLA timeframes

Common Mistakes to Avoid

  • Recording only the signer’s name without linking to a document ID creates ambiguity during audits and weakens evidentiary value.
  • Entering mismatched names or misspelled ID data increases the risk of rejected verifications and may trigger rework or regulatory inquiries.
  • Using weak authentication (email-only) for high-risk transactions fails to meet reasonable identity-proofing standards and may void reliance on the attestation.
  • Failing to retain RON audio-video or verifier logs in accordance with state rules undermines enforceability and can cause compliance failures.

Primary Risks and Potential Penalties

I-9 Paperwork: Violations can incur $281–$2,789 per occurrence
Intentional Misstatement: Penalties of $660 or more per form for intentional disregard
Backup Withholding: Incorrect TINs may trigger 24% backup withholding
Regulatory Rejection: Insufficient verification can lead to transaction denial or rescission
Civil Liability: Fraud or negligent verification may produce contract liability
Operational Delay: Incomplete attestations cause processing and closing delays
