What an ILIT Crummy Trust Is and how it works

An Irrevocable Life Insurance Trust (ILIT) using Crummey withdrawal powers is a specialized estate-planning trust that holds life insurance policies outside a grantor’s taxable estate. Donors make annual gifts to the trust; notice of a limited, short-term withdrawal right (a Crummey notice) is provided to beneficiaries so the gifts qualify for the annual gift tax exclusion. The trustee holds and administers the policy, pays premiums from trust funds, and distributes proceeds according to trust terms when the insured dies. Proper drafting, timely notices, and accurate funding are essential to achieve intended estate tax and creditor-protection results.

Why an ILIT with Crummey powers is used in estate planning

The ILIT Crummey structure enables gifts that use the annual gift tax exclusion to fund life insurance outside the grantor’s estate, potentially reducing estate tax exposure while directing liquidity to heirs. It also separates policy ownership from the insured and adds trustee-driven control over timing and distribution of proceeds.

Why an ILIT with Crummey powers is used in estate planning

Who typically establishes or interacts with an ILIT Crummy Trust

Use and administration of an ILIT Crummey Trust involve multiple roles across estate, tax, and family contexts.

  • Estate planners and attorneys advising on tax-efficient life insurance ownership.
  • High-net-worth individuals seeking to limit estate inclusion for insurance proceeds.
  • Trustees and family beneficiaries who receive notices or distributions.

Coordinating counsel, the trustee, and any tax preparer is important to preserve gift exclusion treatment and satisfy reporting obligations.

Primary components included in a professional ILIT Crummey Trust

A well-drafted ILIT with Crummey powers combines trust mechanics, notice procedures, and administrative rules so gifts qualify for the annual exclusion while preserving the trustee’s control over insurance benefits.

Trust Instrument

Detailed irrevocable trust document establishing trustee powers, beneficiary designations, distribution triggers, and anti-inclusion provisions to keep life insurance proceeds out of the grantor’s estate.

Crummey Powers

Explicit withdrawal notice and limited-demand rights for beneficiaries; language must permit a time-limited right to withdraw gifts to satisfy annual exclusion requirements.

Funding Mechanism

Clear provisions for gifting schedules, remittance instructions for premium payments, and accounting procedures so gifts are timely and documented for tax purposes.

Trustee Duties

Trustee responsibilities for accepting gifts, providing Crummey notices, paying premiums, filing trust tax returns, and managing distributions per the trust’s fiduciary standards.

Notice Template

Standardized Crummey notice language, delivery instructions, and retention rules to prove beneficiaries received timely notice of withdrawal rights.

Successor Planning

Successor trustee provisions, successor beneficiary rules, and contingencies for policy lapse, incapacity, or trustee resignation to maintain continuity of administration.

Common mistakes to avoid when preparing an ILIT Crummey Trust

  • Failing to include explicit Crummey language, which can invalidate withdrawal rights and disqualify annual exclusion treatment.
  • Missing or inconsistent beneficiary contact data, which prevents reliable delivery of notices and proof of notice receipt.
  • Not documenting or retaining copies of Crummey notices and proof of delivery, undermining tax positions if audited.
  • Funding the trust late or inconsistently so premiums lapse or gifts do not occur within the notice window.

Penalties and legal risks from incorrect ILIT administration

Estate Inclusion: Gifts included
Gift Tax Liability: Unexpected tax due
Tax Penalties: Late filing penalties
Policy Lapse: Loss of coverage
Creditor Claims: Weakened protection
Audit Risk: Increased IRS scrutiny

Formats, downloads, and supporting documents to store with the ILIT

Preserve signed originals and digital copies in multiple formats and retain supporting documents that substantiate gifts, notices, and premium payments.

Download Formats

Export executed trust and notices as PDF/A and DOCX; PDFs provide a tamper-evident baseline for archives and claims.

Signed PDF

Produce a certified PDF with embedded audit trail showing signer identity, timestamp, and signing events for evidentiary purposes.

Supporting Documents

Retain premium receipts, check images, bank confirmations, and delivery proofs for Crummey notices to substantiate tax positions.

Archival Copies

Keep encrypted offsite backups and a local copy; maintain access controls and an index for quick retrieval.

Primary roles and who can sign ILIT documents

Grantor

The grantor (settlor) creates the ILIT and typically funds it with annual gifts. The grantor must sign or authorize funding transfers and coordinate with the trustee and tax preparer to ensure Form 709 reporting where required; the grantor cannot unilaterally revoke the trust once it is properly executed as an irrevocable instrument.

Trustee

The trustee holds legal title to the life insurance policy, signs trustee notices and claim forms, administers premiums and investments, and acts in a fiduciary capacity toward beneficiaries. Trustees may be individuals or corporate trustees and must follow trust terms and applicable state fiduciary law.
