What Immigration Form I-140 Is and where it fits

Immigration Form I-140, Immigrant Petition for Alien Worker, is a USCIS form employers or sponsors file to request immigrant classification for a foreign national employee. It establishes eligibility for employment-based categories such as EB-1, EB-2 (including National Interest Waiver), and EB-3, and secures a priority date used for subsequent green card processing. The petitioner must show the beneficiary meets education and experience requirements and demonstrate the employer's ability to pay the proffered wage. Approval supports later adjustment of status or consular processing, but does not itself grant permanent residency.

Why filing an accurate I-140 matters

Filing the Immigration Form I-140 secures a beneficiary's priority date and formally establishes eligibility for an employment-based immigrant visa category. It is required to proceed toward adjustment of status or consular processing and documents the employer's ability to pay and job offer details.

Why filing an accurate I-140 matters

Who files or benefits from Form I-140

Who files or benefits from I-140 petitions varies; common filers include employers, self-petitioning professionals, and immigration counsel.

  • Employers sponsoring foreign nationals for permanent positions in specialized, managerial, or exceptional ability roles.
  • Foreign nationals who self-petition under EB-1A or EB-2 NIW where law permits self-sponsorship.
  • Immigration attorneys preparing supporting evidence, labor certification records, and filing strategy for employers or beneficiaries.

Smaller employers often retain counsel to manage documentation, while large organizations centralize immigration tasks within HR or legal operations.

Core sections of the I-140 petition

Core sections of Immigration Form I-140 collect petitioner and beneficiary details, classification request, job offer and wage information, and supporting evidence summaries.

Petitioner Info

Provide the legal petitioner name, employer identification number (EIN), business address, contact information, and the authorized signer's title; accuracy ties the petition to the employer's ability to pay and legal responsibility.

Beneficiary Details

Enter the beneficiary's full legal name, date of birth, country of birth, country of citizenship, alien registration number if any, and current immigration status or admission class.

Classification

Specify the requested employment-based category (for example EB-1, EB-2, EB-3) and indicate subcategory details such as outstanding researcher, multinational manager, or professional skilled worker, and classification rationale.

Job Offer

Describe the permanent job offer, including job title, full job duties, required education and experience, offered wage, and whether the position is full-time or part-time.

Supporting Evidence

Attach labor certification approval where required, academic credentials, reference letters, publications, and documentation proving the employer's ability to pay the proffered wage from petition priority date onward.

The authorized representative must sign and date the form; include contact phone and email. Incorrect or unsigned petitions may be rejected or delayed by USCIS.

Common pitfalls that delay or jeopardize I-140 petitions

  • Incomplete beneficiary evidence often triggers Requests for Evidence; include precise employment letters with dates, duties, and signer contact details to reduce RFEs and delays.
  • Mismatched names or inconsistent dates between the I-140, labor certification, and supporting documents can result in rejection or processing delays.
  • Insufficient proof of ability to pay — e.g., missing tax returns or audited financials — is a common ground for denials in employer-sponsored petitions.
  • Failure to use correct filing fees, filing address, or to include required forms like Form G-28 for counsel delays processing and may cause rejection.

Consequences of incorrect or incomplete filings

Denial: Petition denial halts green card progress
Delays: Longer adjudication, possible deportation risk
Fees Lost: Filing fees are nonrefundable
RFE Costs: Additional evidence prolongs timeline
Priority Date: Retention depends on approved petition
Employer Liability: Incorrect info may trigger penalties
