What the Immigration G-28 Form Is and when it matters

The Immigration G-28 Form is the Notice of Entry of Appearance as Attorney or Accredited Representative filed with U.S. Citizenship and Immigration Services (USCIS) to formally notify the agency that a specific attorney or accredited representative will act on behalf of an applicant, petitioner, or respondent. The form captures representative contact details, the client name and A-number (if known), the representative’s bar or accreditation number, and the scope of representation. Filing a properly completed G-28 with an application or petition ensures USCIS recognizes the representative for service of notices and correspondence related to that case.

Why the G-28 Form matters for representation and case handling

A correct G-28 establishes official representation so USCIS sends notices and requests directly to counsel; it also documents authority to receive confidential case communications. Electronic execution is acceptable under ESIGN (15 U.S.C. ch. 96) and UETA in most states, but certain exceptions or agency rules may apply.

Why the G-28 Form matters for representation and case handling

Who completes and relies on the Immigration G-28 Form

The G-28 is completed by the representative but must reflect the client and case details accurately.

  • Immigration attorneys and law firms who represent noncitizens before USCIS and EOIR; they register bar or accreditation numbers and contact info.
  • Accredited representatives from recognized organizations who are authorized to practice before immigration agencies and list their accreditation ID.
  • Applicants, petitioners, and respondents who authorize a designated representative to receive notices and act on their behalf.

Accurate G-28 information improves mail delivery, reduces miscommunication, and documents authorized representation for administrative and ethical purposes.

Step-by-step: filling and submitting the G-28

Use this concise sequence to prepare a G-28 that USCIS will accept as a valid notice of appearance.

  • 01
Prepare Form: Gather client name, A-number, case receipt number, and representative bar or accreditation data.
  • 02
Complete Fields: Enter contact, identification, and representation scope; check box for full or limited representation.
  • 03
Sign Appropriately: Representative signs and dates; client signature not required on USCIS G-28 in most filings.
  • 04
Attach and File: Attach the G-28 to the initial filing or file it with the specific USCIS form per agency instructions.

How submission and recognition of a G-28 work in practice

Filing a G-28 triggers official recognition of a representative and directs USCIS correspondence to that representative when applied correctly.

  • Attach to Filing: Include the G-28 with the initial petition or application to ensure recognition from the outset.
  • USCIS Processing: USCIS links the G-28 to the case record and updates correspondence preferences if information is complete.
  • Service of Notices: USCIS will send notices and RFEs to the representative’s address when properly recorded on the case.
  • Updating Representation: Submit a new G-28 or written notification when representation begins, changes, or ends.

Essential elements included on a professional G-28 Form

A complete G-28 contains standardized fields and representative credentials; attention to each element reduces the risk of misrouting or nonrecognition by USCIS.

Representative Identity

Full name, title, firm or organization, and mailing address so USCIS can deliver notices and confirm counsel identity for the specific case.

Client Identification

Applicant or petitioner full legal name and A-number or receipt number when known so the form links to the correct USCIS record.

Bar / Accreditation Number

State bar or DOJ accreditation number establishes the representative’s authority to practice and receive official communications.

Scope of Representation

Checkboxes or text clarifying whether representation covers all matters, limited issues, or certain forms and proceedings.

Signature and Date

Representative signature and date in MM/DD/YYYY format; electronic signatures acceptable under ESIGN/UETA when attributable to the signer.

Contact Details

Telephone, email, and a physical mailing address for timely service of RFEs, Notices, and other case communications.

Security, format, and compliance checks to include

Encryption: TLS 1.2/1.3 in transit
Data at rest: AES-256 storage
Audit trail: Time-stamped event history
Auth options: Email, SMS, or KBA
File formats: PDF/A recommended
BAA availability: HIPAA BAA when required

Common preparation errors that delay recognition of representation

  • Leaving the A-number or receipt number blank when available, which can prevent case matching and delay notice delivery.
  • Entering inconsistent client names that do not match the primary filing, causing USCIS to treat the documents as unrelated.
  • Failing to include the representative’s bar or accreditation number and jurisdiction, which may prevent official recognition of authority.
  • Not attaching the G-28 at the time of initial filing or not filing a new G-28 when representation changes, creating gaps in service routing.

Consequences of an incorrect or missing G-28

Nonrecognition: USCIS may not recognize representation
Delayed Notices: RFEs and decisions sent to applicant
Evidence Gaps: Lost opportunity to receive timely requests
Case Confusion: Misrouted correspondence
Ethics Risk: Unauthorized practice concerns
Administrative Burden: Extra filings to correct record

Timing guidance and typical submission triggers

The G-28 should be submitted at key trigger points to ensure continuous recognition of representation and receipt of case communications.

At Initial Filing:

Attach G-28 to the first petition or application whenever possible.

When Representation Begins:

File a G-28 as soon as counsel assumes responsibility for the matter.

On Change of Counsel:

Submit a new G-28 to update USCIS records when counsel changes.

When Withdrawing:

Provide written notice or new G-28 indicating withdrawal as appropriate.

No Separate Fee:

USCIS does not charge a standalone filing fee for Form G-28.
