What the Immigration Status I-765 Form Is and why it matters

Form I-765, Application for Employment Authorization, is a USCIS form used by noncitizens to request permission to work in the United States. The form identifies the applicant, the eligibility category (such as OPT, asylum, TPS, or adjustment-related work authorization), and the supporting evidence required to establish eligibility. Receipt of an approved I-765 results in an Employment Authorization Document (EAD) that employers use to verify work authorization. Accurate completion and correct supporting documents are essential to avoid processing delays, requests for additional evidence, or denials.

Why accurate completion of the Immigration Status I-765 Form matters

Completing Form I-765 correctly helps secure lawful work authorization and avoids delays that can interrupt employment. The form ties your immigration eligibility category, identity documents, and filing history to USCIS case processing and employment verification, so precision reduces the risk of Requests for Evidence and denials.

Why accurate completion of the Immigration Status I-765 Form matters

Who typically files Form I-765

The form is used by multiple immigration groups when seeking or renewing work authorization; categories and evidence differ by eligibility code.

  • F-1 Students (OPT/STEM) — Curricular or Optional Practical Training applicants and STEM extension candidates submitting category (c)(3)(B) or (c)(3)(C).
  • Asylum Applicants and Asylees — Asylum applicants or individuals granted asylum use I-765 to request an EAD once eligible under the relevant category.
  • Adjustment Applicants and Other Categories — Adjustment applicants, TPS beneficiaries, certain H-4, L-2, and other derivative status holders file under their specific eligibility codes.

Confirm the correct eligibility category on the form and attach only the documents relevant to that category to avoid unnecessary processing steps.
