The Insurer's obligations under this Agreement do not include coverage for losses arising from the following matters unless expressly added by endorsement: war or military action, intentional acts or criminal acts by Insured, wear and tear, gradual deterioration, pollution unless specified, fraudulent acts by insured or insured's representatives, and losses otherwise excluded in the policy forms and endorsements.

The Applicant represents and warrants that all information provided in connection with this Agreement and any related application or renewal is true, complete and accurate to the best of the Applicant's knowledge. The Applicant agrees that any material misrepresentation, omission or concealment of fact may render coverage voidable or may allow the Insurer to decline or recover claim payments as permitted by applicable law.

The Applicant authorizes the Insurer to obtain and exchange underwriting, claims and premium payment information with applicable third parties for purposes of underwriting, rating and administering the policy. The Applicant acknowledges the Insurer's right of subrogation and assignment of recoveries to the extent of claim payments made under the policy.

Termination and cancellation: This Agreement is subject to the cancellation and nonrenewal provisions set forth in the underlying policy forms and applicable law. The Insurer may cancel or nonrenew for reasons stated in the policy and as permitted by law after written notice to the Insured.

Dispute resolution: Except as otherwise required by law, disputes arising under this Agreement shall be resolved by binding arbitration before a single arbitrator chosen by the parties, under rules agreed at the time of dispute. The governing law for interpretation shall be the law of the state specified in the policy declarations unless otherwise agreed in writing.

Fraud statement: Any fraudulent claim or material misstatement made by the Applicant or other insured persons shall entitle the Insurer to deny payment and to pursue any remedies available under law.
