Authorization and Assignment (Legal Terms)

I, the undersigned Applicant, hereby appoint and authorize the Insurer, its designated claims representatives, and any attorney retained by the Insurer to take any and all actions reasonably necessary to pursue recovery, subrogation, or reimbursement from any third party or their insurer for benefits paid or payable on account of the injury identified above. This authorization includes, but is not limited to, the right to:

  1. Obtain and inspect all medical records, billing statements, employment and wage records, and other documents relevant to the claim;
  2. Initiate and prosecute claims, suits, or administrative actions against third parties, including settlement negotiations and entry into compromise agreements;
  3. Receive and apply recovered funds to reimburse the Insurer for benefits and expenses paid, including costs of investigation and litigation;
  4. Execute releases, settlement agreements, subrogation assignments, or other instruments necessary to effectuate recovery, subject to the approval requirements set forth below.

Assignment of Recovery: I assign to the Insurer any right of action or claim I possess against any third party to the extent of benefits paid or to be paid by the Insurer arising out of the injury described herein. I acknowledge that recoveries obtained after payment of costs and attorney fees will be used first to reimburse the Insurer for benefits paid and associated expenses.

Settlement Approval: The Insurer shall not compromise or settle any recovery action that would adversely affect my statutory workers' compensation entitlement without first providing written notice and an opportunity to approve any settlement allocation concerning my benefits. Any settlement of a third-party claim that reduces or eliminates the Insurer's right of reimbursement shall require my cooperation in signing necessary documents to protect the Insurer's interests.

What the Insurance AOR WC Form Is and when it’s used

The Insurance AOR WC Form is an Authorization of Representation used in workers' compensation matters to designate an individual or organization to act on a claimant's behalf with an insurer, claims administrator, medical providers, or employer. It typically identifies the claimant, the representative (attorney, claims administrator, or agent), scope of authority, and signature date. The form enables communications, records requests, and benefit negotiation on the claimant’s behalf and often includes consent for release of medical information necessary to process a workers' compensation claim.

Why a clear, properly completed AOR WC Form matters

A correct Authorization of Representation clarifies who may communicate with carriers and providers, reduces processing delays, and documents consent for medical-record requests. For documents with health information, it also establishes the basis for compliant disclosures under federal privacy rules.

Why a clear, properly completed AOR WC Form matters

Who typically completes and signs an Insurance AOR WC Form

The form is completed by and between the claimant and the appointed representative; employers and carriers receive copies for their files.

  • Claimants: injured workers who grant authority to a representative to manage the claim and request records.
  • Attorneys or Claims Representatives: individuals or firms acting for the claimant in negotiations, filings, and communications.
  • Insurers and Employers: recipients who rely on the form to update contact and authorization records.

Ensure each party retains a signed copy; carriers often require a scanned or notarized authorization before sharing protected health information.

Step-by-step: completing and submitting the AOR WC Form

Follow a consistent sequence to reduce rejections: verify identity, complete fields, obtain signature, and deliver copies to necessary parties.

  • 01
Gather documents: Collect claimant ID, claim number, and insurer contact information before starting.
  • 02
Fill required fields: Enter names, addresses, scope, and dates using MM/DD/YYYY format where applicable.
  • 03
Sign and authenticate: Sign in presence of notary if state requires; otherwise apply a compliant e-signature.
  • 04
Deliver copies: Send signed copies to carrier, employer, and representative and retain originals.

How authorization flows after signing

Once the form is signed, follow these routing steps so all stakeholders have the authorization on record.

  • Representative receives form: Representative retains a copy and begins authorized actions on behalf of claimant.
  • Carrier updates file: Carrier records the representative and updates communication preferences.
  • Providers produce records: Medical providers respond to records requests when properly identified and authorized.
  • Ongoing communications: Claims correspondence and negotiations proceed under the granted scope until revocation.

Configuring an online AOR WC workflow

Set up fields, signer authentication, and routing to match your compliance and business rules before sending for signatures.

Field Configuration
Signer authentication Email link or SMS code; use multi-factor for higher assurance
Field types Text, date, checkbox, and conditional fields for scope limitations
Routing order Set representative and carrier as recipients in required sequence
Integration Connect to case management or claims systems for automatic filing

Technical considerations for eSigning and eSubmission

Choose a platform that supports required authentication, audit trails, and file formats before e-submitting an authorization.

  • Supported formats: PDF, DOCX, and scanned images
  • Integrations: Salesforce, NetSuite, Google Workspace
  • Authentication: Email link, SMS code, or advanced methods

Verify the receiving carrier accepts electronic copies and whether a notarized or witnessed original is still required for their file.

Essential sections every professional Insurance AOR WC Form should include

A complete form protects claimant rights and clarifies representative powers; ensure each core section is present and unambiguous.

Claimant identity

Full legal name, claim number, date of injury, and contact details. Accurate identification prevents misrouting and supports timely benefits processing by carriers and providers.

Representative details

Representative name, firm, license or bar number, contact info, and mailing address. Clear identification avoids uncertainty about who may receive protected information.

Scope of authority

Explicit permissions for record access, communications, settlement negotiations, and filing documents. Narrow or broad authority should be stated to reflect the claimant’s intent.

Patient records consent

If medical records are requested, include specific HIPAA-compliant language authorizing release of health information to the representative and carriers.

Effective and expiration dates

Start and end dates for authorization or an open-ended clause. Date clarity affects the representative’s ability to act and the timeliness of record requests.

Signature block

Signature, printed name, date, physical address, and notary or witness lines when required. Authentication choices influence acceptance by carriers and providers.

Security and compliance elements to include or verify

Encryption: TLS 1.2/1.3; AES-256
Audit trail: Timestamped IP and action log
HIPAA readiness: BAA required for PHI
Legal validity: ESIGN and UETA recognition
Access controls: Role-based signer authentication
Retention support: Tamper-evident storage

Common risks and consequences of incorrect or incomplete forms

Claim delays: Benefits payments postponed
Record refusals: Providers decline release
Denial of authority: Carrier rejects representative actions
HIPAA violations: Potential civil penalties
Revocation disputes: Conflicts over valid revocations
Incorrect payee: Settlement funds misdirected

Practical tips to complete the Insurance AOR WC Form accurately

Apply consistent formatting, verify identities, and confirm acceptance policies with carriers and providers to reduce rework and disputes.

Verify claimant identity
Compare the claimant name and birthdate to a government-issued ID before signing; mismatches can block record releases and delay benefits processing.
Be specific about authority
List precise tasks the representative may perform—requesting medical records, negotiating settlements, or accessing claim files—to prevent overbroad interpretation or rejection.
Confirm carrier acceptance
Before sending, contact the insurer or claims administrator to confirm they accept electronic copies, notarized originals, or require additional forms or attachments.
Retain signed copies
Keep both signed originals and secure digital copies with audit trails; documentation supports disputes and demonstrates consent under ESIGN and UETA frameworks.

Examples: how organizations use an Insurance AOR WC Form

Real-world examples show common workflows and outcomes when authorizations are used correctly.

Regional Insurer

A claims unit received a signed authorization and used it to request medical records quickly

  • The representative negotiated a partial settlement within weeks
  • The carrier retained the form and audit trail, which shortened the documentation review and reduced back-and-forth with the claimant.

Employer HR Team

An HR team secured an AOR to allow a third-party administrator to manage communications

  • The administrator coordinated provider records requests efficiently
  • This centralized approach prevented duplicate requests and reduced processing time for time-loss benefit decisions.
