Standard Exclusions

The policy shall not cover loss, damage, liability or expense caused by or resulting from the following, except to the extent specifically endorsed: wear and tear; latent design or workmanship defects; intentional acts or willful misconduct of the insured; punitive or exemplary damages; nuclear hazard; war and civil commotion. Coverage for professional design errors is excluded unless Professional Liability coverage is specifically selected and endorsed.

Declarations, Representations and Conditions

The Insured represents and warrants that the information provided in this contract is true, complete and material to the risk. Misrepresentation, omission or concealment of any material fact shall render the policy voidable in accordance with applicable law.

Premiums and applicable taxes are earned pro rata unless otherwise provided. The insurer may cancel for nonpayment of premium or for any other reason permitted by law upon providing written notice to the insured. The insured shall cooperate with reasonable inspections and loss investigations conducted by the insurer or its representatives.

Waiver of Subrogation: Where required by written contract between the insured and a project stakeholder, and provided the waiver is expressly endorsed, the insurer will waive subrogation rights against such stakeholder to the extent set forth in the endorsement. Such waiver shall not increase the insurer's limits of liability.

Indemnity and Additional Insured: Any obligation to name an additional insured, or to provide indemnity to third parties, must be disclosed in advance and accepted by the insurer in writing and may be subject to additional premium.

Governing Law and Venue: This contract shall be governed by the laws of the jurisdiction in which the insured's principal place of business is located, unless otherwise agreed in writing.

Severability: If any provision of this contract is held unenforceable, the remainder of the contract shall remain in full force and effect.
