The DIC policy excludes, without limitation, loss or expense arising directly or indirectly from: nuclear hazard; war, hostilities or insurrection; intentional acts by the insured; wear and tear, deterioration, latent defects or mechanical breakdown; fraudulent or dishonest acts; and any loss or peril already fully insured by the primary policy where no difference exists. Conditions, Duties, and Certification

1. Applicability: The DIC policy applies only to the extent that there is a difference between the terms, limits, or coverages of the DIC policy and those afforded by the underlying primary policy(ies). Where the primary policy provides coverage, the DIC policy will not duplicate the primary insurer's obligations except to the extent expressly provided in the DIC endorsement.

2. Notice and Cooperation: In the event of a loss which may give rise to a claim under the DIC policy, the insured must promptly notify both the primary insurer and the DIC insurer, provide full cooperation, tender proof of loss and documentation requested, and permit examination under oath. Failure to comply may impair coverage.

3. Subrogation: The insured agrees that, to the extent of payment under the DIC policy, the DIC insurer shall be subrogated to all rights of recovery against third parties. The insured shall execute and deliver instruments and papers and do whatever else is necessary to secure such rights.

4. Premium and Cancellation: Premiums for DIC coverage are payable as set forth in the DIC policy. The DIC insurer may cancel or nonrenew consistent with the terms of the DIC policy and applicable law. Cancellation of the primary policy does not automatically cancel DIC coverage unless the DIC policy so provides.

5. No Amendment: This acknowledgment does not amend, alter, or extend the terms, limits, conditions, exclusions or endorsements of the DIC policy itself. The insured acknowledges responsibility to read the DIC policy and any endorsements for complete terms.

By signing below I certify, under penalty of perjury and to the best of my knowledge, that the information provided in this acknowledgment is true and complete, that I have read and understand the DIC coverage description, limitations and exclusions set forth above, and that I am authorized to request the DIC coverage identified on this form.

I understand that this form is an acknowledgement only and does not bind the insurer to issue or renew coverage beyond the terms of the DIC policy and its endorsements. I authorize the release of information necessary to effect coverage and to process claims.

What the Insurance DIC Acknowledgment Form Is

An Insurance DIC (Difference-in-Conditions) Acknowledgment Form documents that an insured party has received, reviewed, or acknowledged specific DIC coverage terms offered by an insurer or broker. It typically records policy identifiers, covered perils added or excluded, effective dates, limits, and the parties involved. The form provides a written trail showing that the insured was made aware of DIC terms and any changes to primary or excess policies. Organizations use it to formalize risk transfer, confirm receipt of policy amendments, and support claims or audit records.

Why a DIC Acknowledgment Matters

A signed acknowledgment creates documentary evidence that policy changes and DIC terms were presented and understood, reducing coverage disputes and clarifying obligations between insurer, broker, and insured.

Why a DIC Acknowledgment Matters

Who Typically Completes This Form

The form is completed by stakeholders involved in placement, renewal, or amendment of DIC coverage.

Typical Document Flow for a DIC Acknowledgment

This sequence shows common routing from issuance to final storage in corporate records.

  • Prepare Form: Broker or insurer completes draft with policy and endorsement details.
  • Send to Insured: Deliver to the insured via email, secure link, or hard copy for review.
  • Sign and Return: Insured signs, dates, and returns via eSignature or physical signature.
  • Archive: Store the signed acknowledgment in the policy file and claims system.

How to Configure an Online Acknowledgment Workflow

Set up fields, authentication, and retention settings to meet compliance and operational needs.

Field Configuration
Signature Field Require signer's full name and date; enforce required field validation.
Authentication Use email link or SMS code for signer verification; choose stronger methods for higher risk.
Routing Order Set role-based routing: broker -> insured -> carrier for countersignature if needed.
Retention Policy Automatically save signed PDF and audit trail to secure storage for the retention period.

Platforms and Technical Requirements

Ensure your chosen platform supports required eSignature features, secure storage, and audit logging.

  • File Formats: PDF and DOCX support
  • Integrations: Works with CRM and cloud storage
  • Authentication: Email, SMS, or advanced methods

For HIPAA or sensitive financial data, verify BAA availability, encryption standards (TLS/AES-256), and audit trail detail before deployment.

Essential Sections to Include on a Professional Form

Design the acknowledgment to be concise but comprehensive so it stands up under audit and supports claims handling.

Header

Identify document type, insurer, broker, insured, and policy reference to avoid misfiling.

Coverage Summary

List the DIC endorsement name, covered perils, and any exclusions in plain language for quick reference.

Effective Dates

Limits

Specify limits and whether per occurrence or aggregate; note sublimits or separate retentions.

Signatures

Include signer name, title, signature, date, and capacity to bind the entity.

Audit Trail

Record method of delivery, signer authentication, IP, and timestamps for evidentiary value.

Security and Compliance Essentials

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Comprehensive timestamps and event logs
Access Controls: Role-based permissions and SSO
HIPAA Support: BAA available where required
ESIGN/UETA: Legal e-signature compliance
Certifications: SOC 2 Type II and ISO 27001

Common Pitfalls to Avoid

  • Incomplete identification fields: leaving the legal entity name or policy number blank creates ambiguity during claims and can delay coverage verification.
  • Using ambiguous language for coverage scope: vague descriptions of what the DIC fills can lead to disputes between primary and DIC carriers.
  • Failure to record effective dates correctly: inconsistent or missing dates can create gaps in coverage and complicate claim allocation.
  • Insufficient signer authority: accepting signatures from persons without delegated authority risks challenges to the acknowledgment's validity.

Risks and Consequences of Errors

Coverage Disputes: May cause denial or delayed claims payment
Contractual Exposure: Creates ambiguity in indemnity obligations
Regulatory Scrutiny: Recordkeeping failures can trigger audits
Reputational Loss: Persistent errors harm broker/insurer credibility
Financial Loss: Unclear limits may increase out-of-pocket costs
Documentation Fines: Applicable where statutory disclosure rules apply

Timing: When to Issue and Return the Form

Time the acknowledgment to align with placement, renewal, or endorsement effective dates to ensure continuous protection.

Upon Endorsement:

Issue when the DIC endorsement or amendment is issued by carrier

Prior to Effective Date:

Return signed copy before the DIC effective date when possible

At Renewal:

Provide updated acknowledgment with each renewal or material change

Before Claims:

Confirm acknowledgment exists prior to reporting a claim if required by agreement

Record Retention Start:

Retention period begins on signature date or effective date as specified
