What an Insurance EPLI Proposal Is

The Insurance EPLI Proposal is a standardized application packet used by employers and brokers to request Employment Practices Liability Insurance coverage from carriers. It compiles company identification, workforce composition, payroll by classification, claims history, HR policies, and requested limits and deductibles so underwriters can assess exposure to wrongful termination, discrimination, harassment, and retaliation claims. Well-prepared proposals include loss runs, training records, and investigation policies that demonstrate loss control, reduce underwriting follow-ups, and support accurate pricing and coverage decisions.

Why a Complete Proposal Matters for Coverage and Pricing

Submitting a complete Insurance EPLI Proposal standardizes underwriting review, documents mitigation controls, and clarifies coverage needs. It can shorten quote timelines, reduce follow-up requests, and give underwriters the data they need to price and shape Employment Practices Liability terms accurately.

Why a Complete Proposal Matters for Coverage and Pricing

Who Typically Prepares and Reviews Proposals

Typical users completing an Insurance EPLI Proposal include brokers, risk managers, HR leads, and carriers during underwriting and renewal reviews.

  • Insurance brokers preparing comparative quotations and binding recommendations to carriers.
  • HR or compliance officers providing company policies, investigation records, and mitigation plans.
  • Underwriters assessing claims history, financial exposure, and required endorsements for underwriting decisions.

Each party focuses on different sections: brokers on comparatives, HR on policies, and underwriters on claims and exposure metrics.

Essential Sections to Include in an Insurance EPLI Proposal

A professional Insurance EPLI Proposal groups exposure data, loss history, risk controls, requested coverage, financials, and supporting attachments to give underwriters a complete view.

Company Overview

Provide legal entity name, FEIN, primary address, operations description, subsidiary list, employee counts by class, and payroll by classification to support exposure calculations.

Claims History

List employment-related claims for the last five to ten years with dates, causes, reserves, payments, and current status; attach carrier loss runs when available.

Policies & Procedures

Summarize hiring, termination, anti-harassment, discrimination investigation procedures, employee handbooks, and training programs that demonstrate enterprise risk controls.

Financials & Payroll

Provide annual payroll totals, state-by-state payroll split, and revenue figures; disclose contingent pay like commissions or bonuses affecting exposure.

Coverage Requested

Specify desired limits, retention/deductible, retroactive date or prior acts coverage, and any endorsement or exclusion requests for carrier consideration.

Attachments

Key Processing Milestones from Draft to Binding

Milestone sequence from data collection to binding shows expected checkpoints during the Insurance EPLI Proposal lifecycle.

01

Data Collection

Gather payroll, org charts, and loss runs.

02

Submission to Broker

Broker reviews and forwards to carriers.

03

Underwriting Review

Carrier requests clarifications or offers terms.

04

Bind Coverage

Binder issued after acceptance and premium payment.

Common Preparation Errors to Avoid

  • Incomplete loss runs or missing claim detail causes underwriters to request additional documentation and can delay binding by weeks, increasing exposure during the gap period.
  • Using inconsistent payroll or employee counts between sections leads to premium miscalculation and may trigger mid-term audits or policy amendments.
  • Failing to disclose prior investigations, EEOC charges, or settlements can result in rescission or denial of coverage for related claims.
  • Uploading poor-quality attachments or unsigned documents forces manual follow-up and may be treated as nonresponsive by underwriters, slowing processing.

Risks and Consequences of Inaccurate or Incomplete Proposals

Coverage Denial: Claims excluded for misrepresentation.
Policy Rescission: Carrier may void policy.
Premium Audit: Back-charges or audits possible.
Delayed Binding: Operational exposure while waiting.
Regulatory Risk: State insurance regulators may investigate.
Legal Liability: Company may face indemnity disputes.

Required Data Elements and Security Notes

Personal Data: Collect minimal PII for underwriting.
SSN/TIN: SSNs only when required for verification.
Health Data: Avoid PHI unless required; HIPAA applies.
Audit Trail: Timestamp, IP, signer identity stored.
Encryption: TLS 1.2/1.3 in transit; AES-256 at rest.

Realistic Examples of Proposal Outcomes

Two illustrative scenarios show how complete proposals affect underwriting, pricing, and contract terms for different employer profiles.

Mid-Sized Healthcare Employer

A 300-employee regional hospital compiled ten years of loss runs and updated harassment training records before submission.

  • Result: underwriter reduced exclusions and offered competitive pricing.
  • Because the proposal documented corrective actions and organized training evidence, the carrier narrowed exclusions and reduced retention, improving protection and lowering expected out-of-pocket exposure over the policy term.

Small Tech Startup

A 50-employee software firm documented independent contractor arrangements and payroll classifications ahead of a renewal bid.

  • Result: premium adjusted to reflect true payroll exposure.
  • Clear classification and supporting payroll schedules prevented mid-term audit surprises, produced a tailored limit recommendation, and avoided a retroactive premium increase after the carrier completed its review.

Practical Tips to Improve Accuracy and Speed

Adopt these best practices to make Insurance EPLI Proposals consistent, auditable, and faster to underwrite.

Double-check numeric consistency
Reconcile payroll totals, employee counts, and financial figures across all sections. Mismatched numbers trigger audits and premium adjustments; consistent figures reduce carrier requests and improve quote accuracy during underwriting.
Document mitigation measures
Provide training rosters, investigation procedures, and disciplinary records. Concrete evidence of proactive risk management influences underwriting positively and can justify more favorable terms or lower premiums when carriers evaluate loss control.
Provide corroborating attachments
Attach signed employee handbooks, sample employment agreements, and recent loss run reports. Clear, organized attachments reduce iterative follow-up, shorten underwriting cycles, and help carriers perform faster and more accurate risk assessments.
Use clear signature authority
Ensure the signer is an authorized officer and include printed name, title, and date. Attach corporate resolutions if authority is delegated to an HR director or broker to avoid invalidation of signatures.
