Exclusions & Important Notices

The Fair Plan provides basic property coverage subject to the policy forms, endorsements and applicable state law. Coverage does not include losses caused directly or indirectly by flood, earthquake, earth movement, landslide, nuclear hazard, war, intentional or criminal acts by the insured, wear and tear, mechanical breakdown, or any other loss specifically excluded by the policy. Additional coverages may be available by endorsement and are subject to underwriting approval and additional premium.

Applicant acknowledges that acceptance of this application and issuance of a policy depend on underwriting review and verification of information provided. Failure to disclose material facts or any misrepresentation may result in denial of coverage or rescission of the policy. This application does not bind the insurer to issue a policy nor does it bind the applicant to accept any policy offered.

Authorization, Certification and Fraud Warning

By signing below, the applicant certifies that the statements and answers contained in this application are true, complete and correctly recorded to the best of the applicant's knowledge and belief. The applicant authorizes inspection of the property and access to relevant records for underwriting and claim handling purposes and authorizes release of loss history and prior insurance information to the insurer.

The applicant further certifies that reasonable efforts were made to procure insurance in the voluntary market and that this application is submitted under the Fair Plan due to inability to obtain coverage through admitted insurers. Misrepresentation of any material fact in this application or submission of false information for the purpose of obtaining insurance is a fraudulent act and may be subject to civil and criminal penalties under applicable law.

Prior Losses (Detail Table)

Provide dates and descriptions for prior losses. If none, write "None".

Acknowledgment

Applicant acknowledges that premiums are due at inception and that coverage is effective only upon issuance of a policy and receipt of payment as required by the insurer. Applicant understands that if coverage is bound conditionally, any misstatement or omission in this application may be grounds for cancellation or rescission of coverage.

What the Insurance Fair Plan Application Is

The Insurance Fair Plan Application is the standardized form used to request coverage from a state or regional Fair Access to Insurance Requirements (FAIR) plan, an insurer of last resort that provides property insurance when voluntary markets decline or refuse coverage. The application records property characteristics, ownership and occupancy details, prior loss history, security and mitigation features, and proposed coverage limits so administrators can assess eligibility and estimate premium. Typical applicants are homeowners, landlords, and commercial property owners who cannot obtain comparable private-market insurance. This guide explains the form, common requirements, and completion tips for U.S. users.

Why the Application Matters for Coverage and Compliance

Using a completed Insurance Fair Plan Application documents an applicant’s eligibility and risk factors, speeds underwriting for high‑risk properties, and creates an auditable record that supports claims and appeals. Proper completion reduces delays, errors, and the chance of incomplete eligibility determinations.

Why the Application Matters for Coverage and Compliance

Who Typically Completes the Application

Typical users include homeowners, landlords, insurance agents, and brokers submitting applications for properties declined by voluntary insurers.

  • Homeowners and landlords seeking coverage when standard insurers decline due to location, prior losses, or building condition.
  • Agents and brokers submitting on behalf of clients to access FAIR plan coverage or to document declined market offers.
  • Lenders or servicers requiring insurance evidence for collateral protection when voluntary market options are unavailable.

Each participant’s role determines required attachments and signature authority; review submission guidelines and state rules before filing.

Core Sections Included in a Professional Application

Every Insurance Fair Plan Application includes standard sections that capture property details, coverage requested, prior losses, mitigation measures, ownership data, and required declarations.

Property Details

Provide the full street address, parcel or APN, construction type, year built, square footage, number of units, occupancy type, and any detached structures to give underwriters a complete risk profile.

Ownership & Title

List the legal owner, entity type, mailing address, tax ID for businesses, mortgagee names, and any outstanding liens or encumbrances that could affect insurability or claims handling.

Prior Losses

Disclose previous claims for the past five to ten years as requested, including dates, causes, amounts paid, and corrective actions taken to mitigate recurrence, and supporting documentation if available.

Mitigation Measures

Describe active fire protection, alarm systems, sprinkler coverage, roof and exterior upgrades, security measures, and any recent risk mitigation inspections or certificates, including dates and installer or contractor names where applicable.

Coverage Requested

Specify limits for dwelling, other structures, personal property, liability, deductibles, endorsements, and effective date; note requested policy term and any optional coverages and indicate if flood or earthquake endorsements are sought.

Declarations & Signatures

Ensure each named insured and authorized agent signs and dates, declares accuracy under penalty of perjury where required, and provides contact and licensing information for verification.

Required Information and Key Fields

Applicant Name: Full legal name as on ID
Property Address: Street, city, state, and ZIP
Ownership Entity: Individual or legal business name
Coverage Limits: Requested limits and deductibles
Loss History: Claims history for the past five years
Signatures: All insured signatures and dates

Penalties and Risks of an Incorrect Application

Application Rejection: Missing data can cause denial
Delayed Coverage: Processing delays postpone effective date
Higher Premiums: Undisclosed losses raise rates
Claims Denial: Material misstatements may void claims
Regulatory Penalties: False statements risk fines
Tax/Legal Issues: Incorrect ownership causes title disputes

Common Preparation Pitfalls to Avoid

  • Incomplete property descriptions, such as missing APN or incorrect unit counts, commonly slow underwriting and require supplemental requests that delay issuance.
  • Failing to disclose prior claims, open losses, or renovations can lead to premium adjustments or coverage rescissions when uncovered during inspection.
  • Using abbreviations, incomplete addresses, or P.O. boxes instead of a physical location may invalidate the application for properties requiring on-site verification.
  • Incorrect signer authority — for example, an unauthorized representative signing for a corporation — risks rejection and may require notarized ratification.

Step-by-Step: Complete and Submit the Application

Follow these steps to complete and submit the Insurance Fair Plan Application accurately and efficiently.

  • 01
Gather Documents: Collect deed, prior policies, loss records, and identification.
  • 02
Complete Form: Fill every required field and attach explanations when applicable.
  • 03
Review & Sign: Verify details, ensure authorized signer signs and dates.
  • 04
Submit: Send to FAIR plan administrator per state instructions.

How Submission Routes Typically Work

The submission route varies by state; typical flows include agent submission, online portal filing, or mailed packet to the FAIR plan administrator.

  • Agent Submission: Agent uploads form with attachments via insurer portal.
  • Online Portal: Some states accept direct online filing with conditional field validation.
  • Mail or Fax: Paper packets mailed or faxed when electronic filing is unavailable.
  • Underwriting Review: Administrator verifies details, may order inspection and issue terms.

Download, Save, and Package Supporting Documents

Common supporting forms and download/export options affect submission readiness; create a complete packet in PDF or DOCX with clearly labeled attachments to streamline review.

Export Formats

Save the completed application and all attachments as PDF/A when possible to preserve layout and signatures, or as DOCX if the recipient requires editable source documents for underwriting adjustments.

Supporting Documents

Include prior policy declarations, loss run reports, building plans, inspection certificates, photos of property condition, proof of mitigation work, and any municipal permits or certificates.

File Naming

Use clear filenames that include property address, document type, and date (for example: 123 Main St_lossrun_2025-08-01.pdf) to aid administrator processing and reference number tracking.

Retention Copy

Keep an exact signed and dated copy in your records, stored securely for the applicable retention period and ready for claims, audit requests, or legal review.

Practical Tips for Accurate, Efficient Completion

Practical tips reduce errors and accelerate FAIR plan application approval; prioritize accuracy, documentation, and clear signer authority.

Verify signer identity and signing authority
Confirm each signer's legal name and capacity (owner, officer, authorized agent). If corporate, attach board resolution or power of attorney. Incomplete authority documentation commonly triggers underwriting delays or request for notarized proof.
Attach complete loss history and docs
Provide loss runs listing dates, amounts paid, reserves, and descriptions. Attach supporting invoices or repair receipts where available. Transparent loss disclosure reduces premium surprises and speeds underwriting acceptance, especially for properties with recent claims.
Use clear physical property descriptions and measurements
Record building materials, roof type and age, occupancy per unit, and precise square footage. Note any recent renovations and contractor details. Accurate physical data prevents misclassification and coverage gaps during inspections.
Submit organized supporting packets with numbered attachments
Number attachments and include a cover sheet listing contained documents. Ensure photos are dated and labelled. Organized packets reduce administrative review time and lower the chance of follow-up requests that delay policy issuance.

Key Timeframes and Deadlines to Watch
