Exclusions and Limitations

The policy does not cover loss or liability caused directly or indirectly by: wear and tear, gradual deterioration, vermin, deliberate acts by tenant, intentional concealment or fraud, government action, war, nuclear hazard, or any peril expressly excluded by endorsement. Coverage for flood, earthquake, ordinance or law, and similar perils is provided only when specifically endorsed and subject to the terms of those endorsements.

Insurable Interest and Duty to Disclose: The Insured warrants that all statements made in this policy application and attachments are true and complete to the best of the Insured's knowledge. Material misrepresentation, concealment of a material fact, or breach of warranty may render coverage voidable from inception.

Duty After Loss: In the event of loss, the Insured must: (a) give immediate written notice to the Company; (b) protect the property from further damage; (c) provide a detailed inventory of damaged property, proof of ownership, and estimates of repair or replacement costs; (d) submit to examination under oath if requested. Failure to comply may result in denial of claim to the extent the Company is prejudiced.

Subrogation: Upon payment of any loss, the Company is subrogated to the Insured's rights of recovery against any responsible third party. The Insured shall preserve and not impair such rights and shall execute all papers required to secure and enforce the Company's rights.

Cancellation and Nonrenewal: This policy may be cancelled or nonrenewed in accordance with the terms set forth in the policy. The Company will provide the Insured written notice as required by applicable law or the policy provisions. Premium refunds, if any, shall be calculated pro rata unless otherwise stated.
