Coverage Election

The Insured must select either inclusion or exclusion of Terrorism Liability Coverage. Select one option only; selection is binding for the policy period shown above.

I elect to INCLUDE Terrorism Liability Coverage under the terms, limits and endorsements of the policy, subject to any sub-limits, deductibles and exclusions stated herein or in the underlying policy.

I elect to EXCLUDE Terrorism Liability Coverage and acknowledge that acts of terrorism shall not be covered under the policy for the policy period specified, except as may be required by applicable law.

Coverage Details and Acknowledgements

If Terrorism Liability Coverage is elected, coverage shall be subject to: (a) the terms, conditions and exclusions of the underlying policy and any terrorism endorsement; (b) any specific sub-limit applicable to terrorism losses; and (c) any applicable terrorism deductible. The Insured acknowledges that sub-limits and deductibles for terrorism may differ from other risks under the policy.

The Insured acknowledges and accepts any terrorism sub-limit or sub-limits as stated above and in the policy endorsements.

The Insured authorizes the insurer to charge the terrorism coverage premium indicated above if inclusion is elected and acknowledges that premium is fully earned in accordance with policy schedule and endorsements.

Exclusions Specific to Terrorism Coverage

Declaration and Certification

The Insured declares that the statements and selections made in this Insurance Liability Terrorism Form are true, complete and correct to the best of the Insured's knowledge. The Insured understands that the insurer will rely upon these statements in issuing or endorsing the policy. Any material misrepresentation, omission, or concealment of fact may result in denial of coverage or rescission of the terrorism coverage portion of the policy as permitted by the policy terms and applicable law.

The Insured acknowledges that: (a) election to include terrorism coverage subjects the Insured to the terrorism premium, sub-limits and deductibles stated herein and in the policy endorsements; (b) election to exclude terrorism coverage removes coverage for losses arising from acts of terrorism as defined in the policy except as otherwise required by applicable law; and (c) acceptance of this election by the insurer may be conditioned on underwriting review.

The Insured authorizes the insurer to share underwriting, claims and policy information relevant to this election with reinsurers and third-party administrators in connection with the placement and administration of the terrorism coverage.

What the Insurance Liability Terrorism Form Is

The Insurance Liability Terrorism Form documents whether and how an insurance policy covers liability arising from acts of terrorism, recording endorsements, limits, exclusions, and any premium adjustments. Carriers use the form to accept or decline terrorism liability exposure and to state the specific scope of coverages, including whether federal backstops under the Terrorism Risk Insurance Act (TRIA) apply. Policyholders receive a formal record of the insurer’s position on terrorism liability, applicable deductibles or retentions, and any special notice or reporting obligations tied to covered events.

Why this form matters for risk allocation

The form clarifies whether terrorism-related liabilities are insured, reduces later coverage disputes, and records premium and policy changes tied to terrorism coverage decisions.

  • Failing to record the effective date in MM/DD/YYYY format which can create disputes about whether an event falls inside the coverage period.
  • Leaving coverage selection ambiguous by checking multiple boxes or using open-ended language instead of specifying included or excluded items.
  • Not preserving a tamper-evident PDF and audit trail when signing electronically, which weakens evidence of intent and attribution.

Practical tips for accurate and efficient completion

Follow these practices to reduce rework, accelerate approvals, and create a durable record that supports claims and audits.

Confirm identity details before filling
Verify the insured’s legal name, policy number, and broker details against the master policy record to avoid mismatches that cause delays or misfiled endorsements.
Use templates with locked fields
Create a standardized form template that locks critical fields (policy number, effective date, coverage selection) so users cannot inadvertently change required fields.
Capture a full audit trail
When signing electronically, ensure the provider captures signer attribution, timestamps, IP addresses, and a certificate of completion to support legal validity.
Coordinate with regulatory reporting
If terrorism coverage triggers federal or state reporting (for TRIA or state filings), align timing and record copies so reporting deadlines are met.
