Exclusions and Limitations

This policy does not cover loss or damage caused directly or indirectly by the following, unless specifically added by endorsement: (a) wear and tear, deterioration, inherent vice; (b) intentional acts of the insured; (c) ordinance or law requiring demolition or reconstruction; (d) nuclear hazard; (e) war, insurrection, or governmental seizure; (f) pollution or contamination except as provided by endorsement. Additional exclusions and limitations may apply and are set forth in the policy form and endorsements.

Mortgagee Clause and Lender Protections

It is understood and agreed that loss, if any, shall be payable to the Mortgagee named in this policy to the extent of its interest as mortgagee. The insurer shall give written notice to the Mortgagee at the mortgagee address provided in this application of any cancellation, nonrenewal, or material change affecting the interest of the Mortgagee, subject to the terms of the policy and governing law. The insurer's obligations to the Mortgagee are separate from its obligations to the Insured and are subject to the policy's terms, conditions and limitations.

If the insurer denies payment to the Insured or the Insured fails to comply with the policy conditions in a manner that would defeat recovery, the Mortgagee's rights to recover under this clause shall not be prejudiced provided the Mortgagee: (a) notifies the insurer of any known change in ownership or occupancy; (b) submits proof of loss when requested; and (c) will comply with policy provisions insofar as they can affect the Mortgagee's recovery rights.

Claims Reporting, Duties and Subrogation

The Insured must give prompt written notice to the insurer of any loss, safeguard the property from further damage, and submit a signed, sworn proof of loss as required. The Insured authorizes the insurer to investigate and adjust claims. To the extent permitted by law, the insurer may pursue subrogation against third parties; however, the insurer agrees not to exercise subrogation rights against the Mortgagee without prior written consent where the Mortgagee's interest arises solely from being a secured lender and the Mortgagee has complied with policy conditions.

What the Insurance Mortgage Policy Is and When It Applies

The Insurance Mortgage Policy documents the reciprocal obligations between a mortgage lender and an insurer when an insurance product is pledged as security or assigned in connection with a real estate mortgage. It records coverage scope, named insureds, premium payment responsibilities, loss payee or mortgagee clauses, policy term, and procedures for notice and claims handling. Lenders use the policy to protect collateral value and to confirm that insurance proceeds will be available to satisfy outstanding loan balances. Parties should ensure endorsements naming the mortgagee and any assignment language are included and consistent with the loan documents.

Why a Clear Insurance Mortgage Policy Matters to Lenders and Insurers

An Insurance Mortgage Policy clarifies rights to insurance proceeds, reduces lender exposure to uninsured loss, and streamlines claims and endorsement processes. Clear documentation helps avoid disputes over loss allocation, supports loan servicing, and can affect loan underwriting and default remedies.

Why a Clear Insurance Mortgage Policy Matters to Lenders and Insurers

Who Typically Prepares and Reviews This Policy

Lenders, insurers, servicers, and counsel use the Insurance Mortgage Policy to verify mortgagee endorsements, loss-payee status, and premium payment responsibilities.

  • Mortgage lenders: confirm mortgagee clause wording, priority of proceeds, and conditions for direct payment.
  • Insurers: document coverage limits, subrogation rights, and procedures for notice and claims involving a secured mortgage.
  • Servicers and trustees: ensure assignment records, escrow collection responsibilities, and force-placed insurance triggers are clear.

Accurate completion aligns underwriting, servicing, and claims handling across parties and reduces administrative and legal friction during loss events.

Common Preparation Errors to Avoid

  • Using incomplete or inconsistent mortgagee endorsements that omit loss payee language or specify incorrect priority, which can prevent direct payment of insurance proceeds to the lender.
  • Failing to include effective dates or accurate policy numbers, creating ambiguity about coverage periods and exposing collateral to gaps during renewals or cancellation windows.
  • Neglecting to attach or retain endorsements and assignment documents, which complicates claims processing and increases litigation risk for all parties.
  • Relying on handwritten or scanned signature images without secure audit trails or authentication, reducing enforceability under ESIGN and state UETA laws.

Consequences of an Incorrect or Incomplete Policy

Coverage Gaps: Uninsured loss increases lender exposure
Force-Placed Costs: Higher premiums charged to borrower
Claim Disputes: Delay in proceeds reduces loan recovery
Regulatory Fines: Violations of escrow laws may trigger fines
Contractual Breach: Misstated mortgagee clause risks litigation
