Security, Assignment and Insurer Instructions

Applicant assigns to the Finance Company as security all rights to any return premium, refund, dividend or other monies payable under the policy identified above until the Amount Financed, finance charges, fees and other obligations under this Agreement are paid in full. Applicant authorizes and directs the Insurer to make any refund payable under the policy to the Finance Company and to endorse and deliver such refund to the Finance Company.

Exclusions and Additional Fees

The following items are not included in the Amount Financed unless specifically listed: taxes, fees imposed by governmental entities, inspection fees and any payment due as a result of policy endorsements not authorized by the Finance Company.

Declarations, Representations and Certifications

Applicant represents and warrants that all information provided in this Agreement is true and correct, and that Applicant has the authority to pledge the policy as security. Applicant agrees to pay the Amount Financed, finance charges, fees and any applicable costs for collection, including reasonable attorney's fees, in accordance with the terms set forth in this Agreement.

Applicant authorizes the Finance Company to obtain credit reports and to exchange credit and policy information with the Insurer, agents or third parties as reasonably necessary to administer this Agreement. Applicant acknowledges that the Insurer may bill the Finance Company directly for financed premium at the Finance Company's request.

Upon default, including nonpayment or material misrepresentation, the Finance Company may declare the entire balance due and exercise any rights available under this Agreement or at law, including endorsement of refunds, cancellation of the policy and collection of any sums due.

By signing below, Applicant acknowledges receipt of a copy of this Agreement, certifies understanding of the terms, consents to the assignment and security interest in the policy and authorizes the insurer to honor instructions from the Finance Company regarding refunds or endorsements to the extent permitted by the policy and applicable law.
