Declarations, Conditions & Certifications

The Insured declares that all statements and answers contained in this Packet are true and complete to the best of the Insured's knowledge. The Insurer's obligations are subject to the terms, conditions, endorsements, and exclusions set forth in the policy and any attached endorsements.

Fraud or material misrepresentation by the Insured in obtaining coverage or in presenting a claim shall render the policy voidable and may permit rescission or denial of coverage to the extent permitted by law. Notice of cancellation or nonrenewal will be given in writing as required by the policy and applicable law.

Subrogation: Upon payment of any loss, the Insurer shall be subrogated to the rights of the Insured against any third party to the extent of such payment. The Insured must cooperate in preserving the Insurer's subrogation rights.
