Exclusions, Limitations and Important Notices

By signing below the Applicant acknowledges and agrees that the premium funding advanced is subject to the following terms and conditions. Applicant represents that all information provided is true and complete and authorizes verification by the Funders of credit, employment and other information. Applicant understands that the funding is not an insurance policy and does not alter the terms of the underlying policy.

Security Interest and Assignment: Applicant grants the Funders a security interest in any rights to return premiums, commissions, dividends, audit adjustments, cancellation refunds or other remittances that may become payable under the policy. Applicant assigns to Funders all such rights until the indebtedness and all other obligations to Funders are paid in full.

Default Remedies: If Applicant fails to make any payment when due, Funders may declare the unpaid balance immediately due and payable, cancel coverage with the insurer, apply any return premium to the indebtedness, and recover reasonable collection costs, attorneys' fees and court costs. Applicant will remain liable for any deficiency after application of refunds and credits.

No Coverage Warranty: Funders do not guarantee coverage under the insured policy; coverage disputes remain between Applicant and Insurer. Funders may require proof of policy issuance prior to final funding and may withhold funding pending insurer confirmation.

Limitations: Funding does not include taxes, statutory fees, or other government-imposed charges unless explicitly included in the funded amount. Applicant remains responsible for any amounts not funded by Funders.

What an Insurance Premium Funding Application Is

An Insurance Premium Funding Application is a commercial financing request used to obtain third-party payment of an insurance premium. The form captures borrower identity, policy identifiers, premium amounts, requested advance, repayment terms, and any security or assignment language. Funders use the completed application to underwrite credit, confirm coverage with carriers, set finance charges, and document obligations between the insured, insurer, and funder. Accurate information reduces processing delays and supports regulatory, tax, and audit requirements for all parties involved.

Why a Standardized Application Matters

A complete Insurance Premium Funding Application creates a clear legal and accounting record of the financing arrangement. Standardization helps underwriters assess risk, supports accurate premium allocation, reduces disputes, and supplies the documentation needed for tax reporting and compliance reviews.

Why a Standardized Application Matters

Who Typically Completes This Application

Typical users completing an Insurance Premium Funding Application include lenders, brokers, insurance agencies, and insured policyholders.

  • Insurance agencies and brokers who arrange premium financing and submit application details to funders.
  • Insurance premium funders and lenders underwriting credit risk, repayment terms, and collateral assignments.
  • Business owners and individuals applying for financed premium coverage and authorizing payment collection methods.

The completed application is used for underwriting, payment routing, contract formation, and as a retained compliance record by each stakeholder.

Representative Signers and Their Roles

Broker

Brokers collect applicant details, coordinate with insurers, and submit the funding application on behalf of clients. They must confirm policy parameters, premium amounts, and borrower authorization. Accuracy reduces underwriting delays and helps the funder verify coverage and billing schedules efficiently.

Funder

Funders review credit, confirm policy terms with carriers, set financing fees and repayment schedules, and record security interests or assignment terms. They rely on complete applications and supporting documents to underwrite risk and comply with lending and insurance regulations.

A professional Insurance Premium Funding Application organizes borrower, policy, and payment terms clearly to support underwriting, legal review, and downstream payment processing.

Timing Considerations and Typical Response Windows

Key timing considerations and expected response windows for funding applications and associated filings in underwriting and payment cycles.

Submit Before Policy Effective Date:

Application should be received before the policy effective date to ensure funded premium coverage

Underwriting Response:

Allow funder time for credit and carrier verification; timeframes vary by funder and completeness

Notary or RON Scheduling:

If notarization required, allow additional time for in-person or Remote Online Notarization

Tax Reporting Cutoffs:

Provide accurate TINs promptly to avoid backup withholding and IRS reporting delays

Retention and Access:

Retain signed copies per policy and be prepared to produce them for audits or compliance reviews

Common Mistakes to Avoid

  • Submitting incomplete policy information delays underwriting and can result in misapplied funds or declined funding if carrier verification fails.
  • Incorrect or missing tax identification numbers (TIN/SSN) can trigger backup withholding, delay funding, and cause IRS reporting penalties.
  • Using an unauthorized signatory or missing corporate authorization risks unenforceability of the financing agreement and lender refusal to fund.
  • Failing to disclose pre-existing liens or security interests may create conflicts and jeopardize priority of funder rights.
