Contractual Exclusion Language

If the full sinkhole exclusion endorsement is applied, the Policy is hereby amended as follows. The following provision shall be added to and supersede any conflicting provision of the Policy:

Sinkhole Exclusion Endorsement — Exclusion of Sinkhole and Subsidence: The Insurer shall not be liable for loss, damage, cost or expense directly or indirectly caused by, resulting from, arising out of, or contributed to by sinkhole activity, sinkhole collapse, sudden subsidence due to the collapse of an underground void or any earth movement resulting from naturally occurring subterranean dissolution, whether or not such subterranean dissolution occurs over a period of time. For purposes of this endorsement "sinkhole" means a land surface depression formed by the collapse of earth caused by the action of water on underlying soluble rock.

This exclusion applies regardless of whether the loss is direct or consequential, and regardless of any other cause or event that contributed concurrently or in any sequence thereto. Coverage for collapse caused by a peril otherwise covered by the Policy remains subject to the terms, conditions and exclusions of the Policy and is not expanded by this endorsement.

Exclusions and Conditions

Excluded Losses: Losses arising from ground movement, earth settlement, subsidence, sinkhole formation or collapse, landslide, mudflow, earth shifting, sinkhole remediation costs, and any damage to foundations, footings, pavements, driveways, landscaping, pools, or underground utilities caused by the events described in this endorsement are excluded.

Condition Precedent: Where limited sinkhole coverage is selected, the Insurer's obligation to consider a claim is conditioned upon the timely submission of a licensed geotechnical or engineering report demonstrating, to the Insurer's reasonable satisfaction, that structural collapse was proximately caused by a qualifying sinkhole event. Costs of such investigation are the responsibility of the Insured unless otherwise agreed in writing.

What the Insurance Sinkhole Exclusion Form Is

An Insurance Sinkhole Exclusion Form is an endorsement or written amendment to a property insurance policy that specifically removes or limits coverage for sinkhole-related damage. Insurers use this form to clarify whether sinkhole perils are covered, excluded, or subject to differing limits and definitions from the base policy. The form typically identifies the insured property, effective date, scope of exclusion, and any retroactive or prospective application. It is used in underwriting, renewals, or claims disputes where geological risk, local ordinance, or prior damage prompts a focused exclusion.

Why this Form Matters for Property Coverage

Using a clear sinkhole exclusion prevents ambiguity about insurer liability for ground-subsidence losses and reduces post-loss disputes.

Why this Form Matters for Property Coverage

Who Typically Prepares or Signs This Form

The Insurance Sinkhole Exclusion Form is used by parties involved in underwriting, risk transfer, and claims administration.

  • Insurers and underwriters who assess geological risk and set coverage boundaries.
  • Property owners or named insureds who accept, negotiate, or dispute policy terms.
  • Brokers, agents, and legal counsel who document client consent and advise on coverage consequences.

The signed endorsement becomes part of the policy record and should be retained by both insurer and insured.

Step-by-Step: Completing and Executing the Form

Follow these steps in order to ensure the endorsement is valid and linked to the proper policy.

  • 01
Verify Policy: Confirm the correct policy number and named insured before editing the form.
  • 02
Describe Exclusion: Write a precise exclusion clause or select the insurer's standard wording.
  • 03
Sign Authorization: Ensure an authorized insurer rep and the named insured sign and date the form.
  • 04
Distribute Copies: Provide executed copies to the insured, agent, and claims file for recordkeeping.

Typical Workflow for Issuing a Sinkhole Exclusion

This workflow shows how the exclusion moves from underwriting to policy record and claims systems.

  • Underwriting Decision: Underwriter assesses geological risk and elects to offer exclusion language.
  • Form Preparation: Draft endorsement with precise scope, effective date, and insurer signature block.
  • Insured Review: Named insured reviews exclusion and seeks advice from broker or counsel if needed.
  • Execution and Filing: Both parties sign; endorsement is placed on policy and stored in insurer records.

Digital Workflow Settings for Online Completion

Technical Considerations for eSigning and Storage

Use a secure eSignature platform that provides audit trails, tamper-evident storage, and appropriate authentication.

  • File Formats: PDF and DOCX are standard for endorsements.
  • Authentication: Email plus SMS or KBA for higher assurance.
  • Integrations: Connect to policy administration or document management systems.

Retain completed files with their audit logs in a secure repository and ensure access controls align with your records-retention policy.

Essential Components of a Professional Exclusion Form

A complete sinkhole exclusion form should combine precise definitions, effective-dates, signature authority, and storage directions to minimize ambiguity.

Clear Definition

Define 'sinkhole' and excluded perils precisely to limit interpretive disputes over covered events and scope.

Scope and Limits

State whether damage from sinkhole events is fully excluded, subject to a sublimit, or excluded except for specified coverages.

Effective and Retro Dates

Specify the exact effective date and any retroactive provisions that clarify which events are affected.

Policy References

Cite the underlying policy sections and endorsement number to ensure the exclusion attaches to the correct contract.

Signature Authority

Include printed names, titles, and insurer authorization details to demonstrate binding acceptance by both parties.

Recordkeeping Instructions

Note where the executed endorsement will be filed and how long it will be retained for audit and claims purposes.

Supporting Documents and Export Options

Attach related materials and save in interoperable formats to preserve evidentiary weight and ease of retrieval.

Supporting Docs

Attach geological surveys, soil reports, prior claims, or engineering opinions that justify the exclusion and document risk.

PDF Export

Save the executed endorsement as PDF/A to preserve integrity and ensure compatibility with archival systems.

Audit Trail

Include a timestamped audit log showing signer identity, IP address, and signature events for evidentiary support.

Record Formats

Retain both the signed PDF and a machine-readable copy (DOCX or JSON metadata) for policy administration systems.

Common Preparation Pitfalls to Avoid

  • Vague wording that omits a functional definition of 'sinkhole' and invites post-loss interpretation disputes.
  • Failing to match the named insured or policy number exactly, which can break the link between endorsement and policy.
  • Skipping signature authority checks—unsigned or improperly signed endorsements may be unenforceable.
  • Poor retention practices where executed endorsements and audit trails are not kept in a secure, discoverable archive.

Risks and Consequences of Incorrect or Missing Endorsements

Coverage Surprise: Insurer denial of sinkhole-related claims due to an effective exclusion.
Regulatory Inquiry: State insurance departments may review unclear or deceptive policy changes.
Contract Dispute: Litigation risk when parties disagree about the exclusion's scope or applicability.
Administrative Penalties: Fines or corrective orders for misfiled or improperly disclosed endorsements in some jurisdictions.
Premium Adjustment: Retroactive premium recalculation if the endorsement was applied incorrectly.
Recordkeeping Failure: Loss of evidentiary audit trail if executed copies and logs are not preserved.
