What an International Offer Letter Is and When It Applies

An International Offer Letter is a written employment proposal issued by a U.S. employer to a candidate located abroad or to a non-U.S. national. It outlines the role, compensation, start date, work location or remote expectations, immigration contingencies, and any relocation or visa support. The document establishes the initial contractual expectations but may be superseded by a formal employment agreement, local statutory requirements, or visa conditions. Employers should tailor language for cross-border issues such as tax withholding, benefits eligibility, background checks, and applicable governing law.

Why a Clear International Offer Letter Matters

A precise offer letter reduces misunderstanding about start conditions, immigration steps, and compensation. It creates a documented record of the offer terms that supports onboarding, immigration filings, and internal approvals while helping manage compliance with U.S. and foreign requirements.

Why a Clear International Offer Letter Matters

Who Typically Prepares and Reviews These Letters

Final sign-off often requires combined approvals from HR and legal before sending to the candidate.

  • Hiring Manager — Drafts role description and business rationale for the offer; coordinates start date and reporting structure.
  • Human Resources — Prepares compensation, benefits, and onboarding conditions; ensures internal policy alignment and recordkeeping.
  • Legal / Immigration Counsel — Reviews visa contingencies, governing law clauses, and any cross-border compliance requirements.

Common Mistakes to Avoid When Drafting an International Offer

  • Using vague contingency language that fails to specify which party bears relocation or visa costs, causing confusion during onboarding.
  • Omitting currency and tax treatment details, which risks payroll errors and unexpected gross-to-net differences for the candidate.
  • Failing to confirm which jurisdiction's law governs the agreement, which can complicate enforcement and dispute resolution.
  • Skipping a formal legal or immigration review for visa-dependent hires, increasing the likelihood of denial or noncompliance.
