RELEASE OF CONTRACT FOR RIGHT OF WAY SERVICES This Agreement is between _____ (the “Company”), whose address as _____, and _____ (the “Contractor”), whose address _____, collectively referred to as the “Parties.” The Parties have entered into an agreement dated _____, in which Contractor agreed t o perform certain right of way services for Company. Contractor has represented to Company that the right of way service has been fully performed. The Parties desire to be mutually released from their duties and obligations pursuant t o the Contract. In consideration of the mutual covenants and agreements contained in this Release, t he Parties agree as follows: 1. Contractor releases Company, its successors and assigns, from any and all obligations arising under the terms of the contract and any and all claims or demands of every ki nd or character arising under it. 2. Company releases Contractor, its successors and assigns, from any and all obligations arising under the terms of the contract and any and all claims or demands of every ki nd or character arising under it. Contractor represents that: 1. All bills, claims and charges from materials, labor, supplies, equipment, and servi ces incurred by Contractor in connection with the work have been fully paid and there exist no outstanding charges for the same which might be enforced against Company. 2. Contractor has fully paid and satisfied all liability for contributions, payroll and payrol l taxes, use taxes or other forms of taxes, fees, licenses, excise or payments, required by Federa l and state or local laws or regulations, and has fully complied with all requirement s, as to all persons employed and property and material furnished in the performance of his contractual obligations.
