What an International Student Visa Agreement Is

The International Student Visa Agreement is a written contract used by U.S. educational institutions, sponsoring organizations, or exchange program administrators and international students to document responsibilities tied to visa status, program enrollment, and immigration compliance. It typically covers student obligations (attendance, maintaining full-time status), institutional reporting duties to DHS/SEVIS, notification procedures for address or status changes, financial responsibility, and consent for sharing records. The agreement clarifies timelines, required supporting documents for visa maintenance, and the consequences of noncompliance, creating a clear record for both the student and the institution.

Why this agreement matters for students and institutions

Using an International Student Visa Agreement establishes expectations between the student and institution, documents consent for information sharing under FERPA and immigration reporting, and reduces administrative ambiguity around visa maintenance. It supports compliance with ESIGN and UETA when executed electronically and with applicable privacy laws.

Why this agreement matters for students and institutions

Primary users and stakeholders

Educational institutions, international student services offices, sponsors, and exchange program administrators use this agreement to formalize visa-related responsibilities and communications.

  • Designated School Officials (DSOs) and international student advisors who manage SEVIS records and compliance.
  • Students enrolled on F-1 or J-1 visas who must acknowledge program rules, attendance, and address reporting.
  • Third-party sponsors, exchange visitors, or host employers that require formal consent and financial responsibility terms.

Properly completed agreements reduce misunderstanding, aid SEVIS reporting, and provide documented consent for restricted information sharing under FERPA.

Step-by-step: completing the agreement

Complete each section in order, verify identity documents, and confirm SEVIS and institutional fields before collecting signatures.

Core sections to include in a professional agreement

A professional International Student Visa Agreement combines clear visa obligations, reporting protocols, consent provisions, financial terms, data privacy clauses, and signature and retention mechanics.

Visa Obligations

Describe required enrollment level, attendance expectations, authorized employment limits, and reporting of program changes. Be specific about timelines for notifying the institution and consequences for falling out of status.

SEVIS Reporting

State how the institution will report transfers, program completion, address changes, and unauthorized employment to DHS/SEVIS, including timeframes and responsible office or official.

Consent for Records

Include explicit consent to share education and immigration-related records with sponsors, government agencies, and third parties when required for compliance or emergency purposes.

Financial Responsibility

Specify tuition, fees, living expense obligations, refund policy, and sponsor liability. Clarify deadlines for payment and consequences of nonpayment affecting visa maintenance.

Privacy & Data Use

Address FERPA rights, permitted disclosures, data retention limits, and conditions under which health information may be shared consistent with HIPAA and institutional policy.

Signature & Retention

Detail acceptable signature methods (wet, electronic), required witnesses or notarization if any, and how long signed records will be retained and retrieved for audits.

Required data elements to collect

Student Name: Full legal name matching passport.
Passport Number: Exact passport number and country.
SEVIS ID: I-20 or DS-2019 SEVIS number.
Program Dates: Program start and end dates.
Financial Sponsor: Sponsor name and commitment details.
U.S. Address: Street, city, state, ZIP code.

Key risks and potential consequences

Loss of Status: Out-of-status leads to termination of SEVIS.
Visa Revocation: Possible consular or DHS action.
Enrollment Suspension: Institution may suspend or dismiss student.
Financial Penalties: Loss of tuition refunds or fines.
Employment Loss: Unauthorized work can trigger removal.
Data Privacy Risk: Improper sharing breaches FERPA/HIPAA.

Common preparation pitfalls to avoid

  • Incomplete identity fields or mismatched names delay SEVIS linkage and may cause the institution to reject the submission until corrected.
  • Failing to list a U.S. residential address or using a P.O. box prevents accurate SEVIS registration and can violate institutional policy.
  • Omitting sponsor financial documentation or unclear funding statements leads to enrollment holds or visa status questions from DHS.
  • Using informal signature methods without intent or consent documentation risks enforceability under ESIGN and state UETA provisions.

Important reporting and notification timelines

Meet reporting and notification timelines to maintain status; missing deadlines can prompt SEVIS action and potential visa consequences.

Initial Reporting:

Provide signed agreement at or before enrollment start.

Address Updates:

Notify within 10 days of any U.S. address change.

Program Change:

Report transfers, program extensions, or early completion promptly.

Employment Reporting:

Declare on/off campus employment and authorization dates.

Termination Notice:

Notify DSO immediately upon withdrawal or program termination.
