IMPLEMENTATION PLAN
NOW INTO COURT, through undersigned counsel, comes _______________, Mover in
these proceed ings, who proposes to the Court the following joint custody plan for the
care and custody of the minor children, _______________ and _______________ .
1. _______________ and _______________ shall have joint custody of their
children, _______________ and _______________, and each parent shall have all rights,
privileges and responsibilites as provided by Louisiana Civil Code Articles 146 and
250, as amended, except where those rights, privile ges and responsibilites are in
direct conflict with the express provisions of this proposed joint custody plan;
2. The mother shall have the right to physical custod y of the children
during the school year from August through May. Du ring the school year, the father
shall have the right to have the children visit with him the ____ and ____ weekend s of
each month , comencing at ____ o’clock __.M. on ______ and ending at ____ o’clock __.M.
on ______ ;
In addition, the visitation privileges during the holidays shall be alterna ted
by _______________ and _______________ as follows:
A. The parties will alternate the major holidays consisting of Easter, July
4th, Labor Day, Thanksgiving, Christmas Eve, Christmas Day and New Years Day.
B. The children shall be with their father on Father's Day beginning at ____
o’clock __.M. and ending at ____ o’clock __.M.
C. The children's birthday shall be alternated equally between the parties.
D. The Father will have visitat ion for three days during the school holidays
that are in excess of one week in duration, which include Easter,
Thanksgiving, Christmas/New Years;
3. During the summer months of June, July, and August, the father shall have
the physical custody of the children between two we eks after school ends and ending
two weeks before school begins. During the summer visitation period, the mother shall
have the right to visit the children, beginning aft er the second full weekend after
the summer visitation period has begun. In additio n the mother shall have the rights
to reasonable telephone visitation with the children during this period. The father's
obligation of child support will cease during the summer vacation;
4. The father of the minor children will continue to pay
________________($_______ ) Dollars per month in child support and to maintai n the
hospitalization policy currently in effe ct in the two minor children as per The
Amended Judgement dated the ____ day of _______ 20____ ;
5. Where special holiday and/or birthday and/or vacation visitation and/or
physical custody privileges overlap the alternating weekend visitation privileges of
either parent, this shall not change the sequence o f his or her alternative weekend
visitation privileges. The special holiday and/or vacation privileges of either
parent will supersede the alternating weekend visit ation period privileges of the
other respective parent. The respective parent's rights to visitation privileges with
and/or p hysical custody of the child during his birthday period shall supersede all
other visitation or physical custody privileges of the other respective parent;
6. The father and mother are obligated to exchange in formation concerning
the health, education and welfare of the child; they shall c onfer with each other in
the ex ercise of decision -making rights, responsibilities and authority concerning the
major medical, dental, ins titutional, psychiatric or other care and schooling,
education, religious and church placements of the child. Each parent has the right to inspec t and receive all school, medical and other records pertaining to the child.
Both the mother and father shall keep each other informed of their address and phone
number and, particularly, the address and phone num ber of the place where the child
shall reside or are staying, at all times;
7. Notwithstanding the provisions of Paragraph 6 above, the parent having
ac tual physical custody of the child, whether by visi tation or physical custody
privileges, at the time of any medical or dental emergency, shall have the sole responsibil ity for meeting that emergency, and in such emergency the permission of the
other parent is not necessary;
8. The father and mother of the children will be resp onsible for one-half
(1/2) of any and all medical bill incurred on behalf of the child that are not cover ed
by hospitalization insurance; and
9. Each parent is obligated to notify the other in writing at least thirty
(30) days in advance of any move or change of address.
