LOCATION OF WELLS, LINES, ROADS, TANK BATTERIES,AND OTHER STRUCTURES Form 1. No road shall be made, used, or constructed without first obtaining the written consent of the surface owner as to the location or use of the road. All roads made, used, or constructed by Lessee shall be terraced in such a manner to best control and prevent erosion and shal l be maintained in a good and workmanlike manner, in a state of repair equal to or bette r than that which existed on the date of this Lease. Whenever practical, Lessee shall util ize existing roads in conducting its operations. Any new roads built by Lessee shall be located to provide t he least interference with any terracing of lands that are under cultivation. Form 2. No well shall be drilled within ____ feet of any residence, house, barn, tank, water well or windmill located on the lease premises without first obtaining the written consent of Lessor and the surface owner. The determination of this distance shall be made as each well is drilled. This distance requirement applies to any structures now or later placed on the lease premises. Form 3. Lessee agrees to consult with the surface owner regarding the placement of all roads, flow and pipe lines, tank batteries, and other structures, and to locate all of them at such locations that will minimize the interference with the surface use of the land for farming and ranching purposes. In its operations, Lessee will use reasonable efforts to reduce the risk of soil erosion. Form 4. Lessee shall exercise its rights and use the surface of the lease premises in such a manner, and to locate all roads, pipelines, and other structures which it has the right to l ocate on the lease premises at such locations, so as to minimize interference with the use of the surfa ce of the lands for farming purposes on cultivated land, and for ranching purposes on uncultivated land. Lessee shall consult with the owner or owners of the surface regarding the location of all wells, tank battery sites, roads, pipelines, and other improvements, and, to the extent reasonably feasible, to locate them at locations agreed to by the surface owner or owners. Form 5. When possible, Lessee shall place all tank batteries adjacent to existing roads. Where this is not possible, Lessee will place all tank batteries at locations that use no more space within the boundaries of the lease premises than is reasonably necessary. Form 6. Lessee shall conduct all its operations in such a manner that causes the least inconvenience and interference with Lessor’s use of the surface. All surface locations sel ected by Lessee, including without limitation all drillsites, tank batteries, roads, and pi pelines, shall be at locations approved by Lessor, if Lessor owns the surface, which approval shall not be unreasonably withheld. Form 7.Any and all roads established or constructed by Lessee shall be located as near as practicable to the boundaries of the lease premises, or as agreed upon by Lessor and Le ssee prior to establishment or construction of the roads. Form 8. If Lessee, in development of and operations on the lease premises, finds it necessary to build or install roads, written notice of Lessee’s intent to construct a road or roads shall be given to Lessor, and Lessor shall have the right to designate the route to be taken by any road or roads. Lessor must exercise the right to designate the route, in writing, within ____ days of recei ving Lessee’s notice. If Lessor does not exercise this right within the time period provided, Lesse e may proceed with the building or installation of a road along the route of Lessee’s choice. Form 9. Prior to construction, Lessee shall consult with Lessor on the location of tank batteries and roads and shall locate them in accordance with the reasonable agreement of Lessor and Lessee. Where possible, all tank batteries shall be located on the outside perim eter of the lease premises and adjacent to public roads. All roadways constructed by Lessee shall be maint ained and kept free and clear of all weeds.
