What the Labor Condition Statement Template Is

Labor Condition Statement Template is a standardized employer attestation used when requesting H-1B classification for a foreign worker. The template documents wage, work location, bargaining status, and notice to employees and establishes that hiring the foreign national will not adversely affect U.S. workers. Employers complete the form to certify prevailing wage compliance, recruitment steps when applicable, and terms of employment. The completed statement is submitted to the U.S. Department of Labor as part of the LCA filing process and retained with hiring records for regulatory review.

Why a Clear Template Matters for Compliance

Using a Labor Condition Statement Template helps ensure completeness and regulatory compliance by capturing required attestations: wage level, worksite, and employee notice. A clear template reduces errors, simplifies internal review, and supports accurate record retention for audits and visa petitions.

Why a Clear Template Matters for Compliance

Who Typically Prepares and Uses This Template

Employers, HR teams, and immigration counsel use the Labor Condition Statement Template when preparing H-1B filings and related wage attestations.

  • Employers: HR and hiring managers complete attestations and certify wage and worksite details prior to petition filing.
  • Immigration attorneys: review accuracy, ensure supporting documentation, and coordinate LCA submission with DOL procedures.
  • Payroll and compensation teams: verify prevailing wage levels and integrate salary data with payroll systems.

Third-party HR providers and staffing firms also use the template to standardize attestations across clients and locations.

Post for 10 consecutive business days prior to filing.

File Before Petition:

Obtain certified LCA before filing the I-129 petition.

Retention Requirement:

Common Preparation Mistakes to Avoid

  • Entering inconsistent employer names or EINs that do not match payroll and tax records, creating delays during verification and audits.
  • Using vague job descriptions or incorrect SOC codes that fail to match the petition or prevailing wage determination, risking requests for clarification.
  • Failing to retain physical or electronic copies of posted notices and proof of employee notification, leaving the employer unable to demonstrate compliance.
  • Submitting wage figures that differ from payroll records or prevailing wage documentation, which can trigger backpay inquiries or enforcement.

Consequences of Errors or Noncompliance

Civil Penalties: Fines and monetary penalties.
Debarment Risk: Employer may be barred from H-1B filings.
Wage Backpay: Owed back wages to affected workers.
Recordkeeping Violation: Failure to retain required documentation.
I-9 Discrepancies: May trigger fines for employment authorization.
Tax Withholding: Payroll tax reporting issues may arise.

Practical Tips to Reduce Errors and Speed Processing

Adopt consistent conventions and internal checks to reduce review cycles, support audits, and ensure alignment between payroll and petition data.

Standardize Naming Conventions
Use a consistent file naming convention that includes employer name, job title, and date. This practice makes it easier to match LCAs to I-129 petitions and to retrieve records during audits, reducing administrative delay.
Cross-Check Payroll Data
Before finalizing the template, reconcile wage figures against payroll records and prevailing wage determinations. This helps avoid discrepancies that can trigger backpay inquiries and reduce the likelihood of corrective actions.
Document Notice Methods
Keep clear evidence of how employee notice was provided, including screenshots for electronic notices or dated photos of physical postings. Documenting the method prevents disputes about notice compliance during reviews.
Assign Clear Signatory Authority
Designate who may sign LCAs and document their authority. Maintain a list of authorized signers and their approval limits so signatures are valid and defensible under audit.
