Release of Landlord, Waiver of Liability, and Assumption of all Risks of Bodily Injury and Damage to Property Use of Owner’s Property Agreement made on the ___ day of __________, 20___, between _________________ of ___________________________________ (street address, city, county, state, zip code), referred to herein as Property Owner , and __________________ , Inc., a corporation organized and existing under the laws of the state of ______________, with its principal office located at ____________________________________ (street address, city, county, state, zip code), referred to herein as Farms. Whereas, the Owner owns property located at ________________________________ (street address, city, county, state, zip code) , hereinafter called Property; and Whereas, Farms desires to use part of Property in order to produce hay, including mowing operations, storage and fertilizing on Property, hereafter called Hay Operations; Now, therefore, for and in consideration of being allowed to conduct Hay Operations on Property, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned Farms does hereby release Owner, Owner’s heirs, successors, and assigns (collectively Releasees) from all liability for property damages and/or for any physical injury or death that results, directly or indirectly from the use (accidental or otherwise) of Property in said Hay Operations . Farms further agrees to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, or costs that Releasees (or any of them) may incur arising out of or related to the Hay Operations on Property by Farms or any employees or other person acting on behalf of Farms, whether caused by the negligence of the Releasees or otherwise. This Agreement shall be governed by the laws of the State of ____________. Any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
